1/25/2016 <br /> RESOLUTION NO. 15472 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY APPROVING A BUDGET AMENDMENT TO (1) <br /> TRANSFER $1,500,000 FROM THE GENERAL FUND TO THE <br /> GENERAL LIABILITY SELF-INSURANCE FUND AND <br /> APPROPRIATE THE FUNDS FOR CLAIM SETTLEMENT AND (2) <br /> TRANSFER $3,000,000 FROM THE GENERAL FUND TO THE <br /> DOCKTOWN MARINA FUND AND APPROPRIATE THE FUNDS <br /> FOR A CAPITAL EXPENDITURE PROJECT FOR SETTLEMENT- <br /> RELATED DOCKTOWN ACTIVITIES <br /> WHEREAS, On November 9, 2015, the Citizens for the Public Trust and <br /> Ted J. Hannig filed a Petition for Writ of Mandamus and Complaint for <br /> Declaratory and Injunctive Relief against the City in San Mateo Superior Court <br /> ("Petition"); and <br /> WHEREAS, the Petition alleges, among other things, violations of <br /> environmental law and the common law Public Trust Doctrine in connection with <br /> Docktown Marina; and <br /> WHEREAS, the parties have negotiated a settlement which settles their <br /> disputes; and <br /> WHEREAS, by motion, the City Council has approved the settlement <br /> agreement; and <br /> WHEREAS, City Attorney's Office has requested that the City Council <br /> approve a transfer and appropriation from the General Fund in connection with <br /> the settlement. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE <br /> CITY OF REDWOOD CITY, AS FOLLOWS: <br /> (a) $1,500,000 shall be transferred from the General Fund to the <br /> General Liability Self-Insurance Fund and the funds appropriated for claim <br /> settlement. <br /> (b) $3,000,000 shall be transferred from the General Fund to the <br /> Docktown Marina Fund and the funds appropriated for settlement-related <br /> Docktown activities. <br /> * * * <br /> Page 1 of 1 <br /> ATTY/RESO.0008/CC RESO APPROVING BUDGET AMENDMENT&APPROPRIATE FUNDS FOR DOCKTOWN Reso.#15472 <br /> REV:01-19-16 MK MUFF# 613 <br />
