24 <br /> <br />condition before the employee is approved to use family/medical <br />leave to take care of that family member. <br /> <br />Failure to comply with the above requirements may lead to denial of <br />leave. <br /> <br />9.10.3 The employee may elect, or the City may require the <br />employee, to substitute accrued vacation leave or other accrued time <br />off during family/medical leave. Sick leave may be used during the <br />period of family/medical leave in accordance with the sick leave <br />provisions found in Section 9.1 of this Memorandum of Understanding. <br /> <br />9.10.4 The City will maintain contributions for the employee's <br />health benefits under group health plans at the same level as prior to <br />the leave, in accordance with the Family & Medical Leave Act. The <br />equivalent benefits, pay and other terms and conditions of <br />employment upon completion of the leave. <br /> <br />Parental Leave, California Family Rights Act Leave and Pregnancy <br />Disability Leave will run concurrently with Family Medical Leave as <br />permitted by law. <br /> <br /> <br />SECTION 10. HEALTH PLANS <br /> <br />10.1 Health and Cafeteria Plans <br /> <br />10.1.1 The City will contract with the California Public Employee's <br />Retirement System (CalPERS) for participation under the Public <br />Employees Medical and Hospital Care Act (Government Code Section <br />22751, et, seq.), for the purpose of providing medical insurance <br />benefits for employees. <br /> <br />Upon the request of the City, the parties will re-open this Article <br />10.1.1 to meet and confer on modifying 10.1.1 to provide a different <br />group health plan. It is understood that any such change is subject to <br />approval of the P.O.A. membership. <br /> <br />10.1.2 The City's maximum, monthly contribution for each eligible, active <br />employee for a Health Benefit Plan (as referenced in Government <br />Code 22892) shall not exceed the CalPERS minimum contribution, <br />adjusted annually by the PERS Board to reflect any change to the <br />medical care component of the Consumer Price Index and shall be <br />rounded to the nearest dollar. <br /> <br />10.2 Cafeteria Plan <br /> <br />10.2.1 Available Benefits: The City shall establish, in accordance with <br />Section 125 of the IRS Code, a Cafeteria Plan for the purpose of <br />providing employees with access to various health and welfare <br />6.1.C. - Page 35
