17 <br /> <br />any employee whose employment is terminated prior to six (6) months <br />of employment. <br /> <br />At the City's request, an employee who has been absent more than <br />three (3) days must file with the City a statement by a person licensed <br />to practice medicine or dentistry that the employee was under said <br />doctor's care while absent. When an employee returns to work after <br />any absence chargeable to sick leave or as a result of an industrial <br />absence or illness, the City may require a statement from a physician <br />that the employee is in fit physical condition to perform all the duties <br />of his or her position. In addition, the employee may be required to <br />undergo a medical examination at the City's expense to be performed <br />by a doctor designated by the City, before the employee is permitted <br />to return to work. <br /> <br />An employee may use up to five (5) days of accrued sick leave in any <br />calendar year for illness in the immediate family. For the purpose of <br />this Section, immediate family means spouse, domestic partner, child, <br />or parent. <br /> <br /> 9.1.3 Except in cases of extreme emergency or exceptional unforeseen <br />circumstances, in order to receive compensation for absences charged <br />to sick leave, the employee shall notify his/her immediate supervisor <br />no less than one-half hour plus travel time prior to the scheduled time <br />for beginning his/her work duties of the impending absence. At the <br />same time, the employee shall provide the immediate supervisor with <br />a telephone number where he/she can be reached during the term of <br />the absence. The burden of proof of extreme emergency or <br />exceptional unforeseen circumstances shall be upon the unit member. <br /> <br /> 9.1.4 Sick leave with pay shall not be granted or accrued when the disability <br />arises from any illness, sickness or injury purposely self-inflicted or <br />caused by any willful misconduct or when disability is sustained while <br />engaged in a gainful occupation (other than City service) either as an <br />employee, officer, executive or as a business or professional <br />proprietor or partner. <br /> <br /> 9.1.5 In the event an employee has accumulated the maximum sick leave <br />credits of one-thousand two-hundred (1200) hours and the employee <br />becomes so severely ill that he or she exhausts his or her sick leave, <br />the Personnel Officer may, upon written recommendation of the <br />employee's department head, authorize additional sick leave to <br />include any sick leave in excess of the one-thousand two-hundred <br />(1200) hours maximum which may have been lost due to the maximum <br />limitation: provided, however, that sick leave credits were not <br />accumulated for a period of six (6) months or longer. <br /> <br /> 9.1.6 An employee may elect to receive compensation in lieu of sick leave <br />credits for any calendar year (based on the preceding 26 pay periods) <br /> <br />6.1.C. - Page 28
