In order to elect a SIP exception, the following steps must be completed. First, a <br />California Environmental Quality Act (CEQA) Initial Study and Mitigated Negative <br />Declaration (MND) document and a Mitigation Monitoring and Reporting Program must <br />be prepared and submitted for public review and comment. Thereafter, City Council <br />must approve a resolution adopting the MND. Subsequently, the City will apply for a <br />revised permit. In order to do so, the MND and Mitigation Monitoring and Reporting <br />Program must be submitted to the State Water Resources Control Board (SWRCB). <br /> <br />In accordance with CEQA, staff prepared an Initial Study and MND for the project dated <br />October 15, 2015. Subsequently, staff circulated the Initial Study and MND for public <br />review and comment from October 29, 2015 to December 1, 2015 and received no <br />public comments during the public review and comment period. <br /> <br />The MND was revised on January 25, 2016, in accordance with CEQA guideline <br />15074(e), which provides “that a lead agency shall not adopt a mitigated negative <br />declaration for a project within the boundaries of a comprehensive airport land use <br />planGwithout first considering whether the project will result in a safety hazard or noise <br />problem for persons using the airport or for persons residing or working in the project <br />area.” The amended MND considered the project’s impact on noise and safety for <br />persons using the airport and for persons residing or working in the project area and <br />found that there was no impact. <br /> <br />Next Steps <br />After Council approval, staff will submit all of the SIP application documents to the <br />SWRCB. Thereafter, the SWRCB will post the City’s SIP exception request for a 30-day <br />public notice period. Following this step, SWRCB staff will schedule a request for Permit <br />reopening to add the City to the Permit exception list on a SWRCB meeting agenda. If <br />the City is listed in the revised Permit, the City will be authorized to discharge copper to <br />receiving waters in excess of water criteria on a short term or seasonal basis. <br /> <br />ALTERNATIVES <br />Council may elect not to adopt the resolution. However, this would have a detrimental <br />effect on the City’s ability to maintain the Lagoon safely and appropriately because the <br />City would not be authorized to use copper-based algae and aquatic vegetation controls <br />at Redwood Shores Lagoon. <br /> <br />FISCAL IMPACT <br />Adopting the resolution has no fiscal impact on the City. There is sufficient funding in <br />the Public Works operating budget to implement aquatic weed control utilizing copper- <br />based algaecides/herbicides. <br /> <br />ENVIRONMENTAL REVIEW <br />An Initial Study was prepared and found that project-specific effects can be mitigated to <br />a less-than-significant level. A Mitigated Negative Declaration (MND) was prepared and <br />circulated for a public review from October 29, 2015 to December 1, 2015. Mitigation <br />measures were identified to reduce potentially significant impacts related to <br />6.3.A. - Page 3
