<br />203193300.19 -9- <br /> <br />1.91 “Parties” shall mean MTC and Operator, and “Party” shall mean one of them, as the <br />context requires. The term “parties” shall mean, collectively, Operator, MTC and the Participating Cities. <br />1.92 “Payment Breach” has the meaning given such term in Section 15.3.1. <br />1.93 “Peak Hours” has the meaning given such term in Section 2.6.2(b). <br />1.94 “Peninsula Pilot Cites” shall mean the cities of Mountain View, Palo Alto and Redwood <br />City. <br />1.95 “PII” has the meaning given such term in Section 2.15. <br />1.96 “Person” shall mean any human being or any association, firm, partnership, joint venture, <br />corporation, limited liability company, governmental entity or other legally recognized entity, whether for <br />profit or not for profit. <br />1.97 “Pilot Cities” has the meaning given such term in the Recitals. <br />1.98 “Phase” shall mean any one of Phase I, Phase II, Phase III, Phase IV and Phase V, as the <br />context requires, and Phases shall mean, collectively, Phase I, Phase II, Phase III, Phase IV and Phase V. <br />1.99 “Phase I” has the meaning given such term in Section 3.4.1. <br />1.100 “Phase II” has the meaning given such term in Section 3.4.2. <br />1.101 “Phase III” has the meaning given such term in Section 3.4.3. <br />1.102 “Phase IV” has the meaning given such term in Section 3.4.4. <br />1.103 “Phase V” has the meaning given such term in Section 3.4.5. <br />1.104 “Phase I Stations” has the meaning given such term in Section 3.4.1. <br />1.105 “Phase II Stations” has the meaning given such term in Section 3.4.2. <br />1.106 “Phase III Stations” has the meaning given such term in Section 3.4.3. <br />1.107 “Phase IV Stations” has the meaning given such term in Section 3.4.4. <br />1.108 “Phase V Stations” has the meaning given such term in Section 3.4.5. <br />1.109 “PPI” shall mean the Producer Price Index for the United States, as measured by the <br />Producer Price Index for final demand, as published from time to time by the Bureau of Labor Statistics, <br />U.S. Department of Labor. <br />1.110 “PPI Adjustment” shall mean, with respect to a specific cost, that such cost is subject to <br />annual adjustment each January 1 based on changes in the PPI from the Effective Date to the date of <br />adjustment.
