3/9/2016 Applicable Ar ticles from the California Constitution <br />http://www.slc.ca.gov/lawsr egs/const.htm l 1/2 <br /> <br /> <br />Applicable Articles from the California Constitution <br />Article 1, Section 25. <br />The people s hall hav e the right to fis h upon and from the public lands of the State and in the waters <br />thereof, ex cepting upon lands s et as ide for fish hatc heries, and no land owned by the State s hall ev er <br />be s old or transferred without res erv ing in the people the abs olute right to fis h thereupon; and no law <br />s hall ever be pas s ed mak ing it a c rime for the people to enter upon the public lands within this State for <br />the purpos e of fis hing in any water containing fish that hav e been planted therein by the State; <br />prov ided, that the legis lature may by statute, prov ide for the s eas on when and the c onditions under <br />whic h the different species of fis h may be tak en. <br />Article 10, Section 3. <br />All tidelands within two miles of any inc orporated c ity , city and c ounty , or town in this State, and <br />fronting on the water of any harbor, estuary, bay, or inlet us ed for the purposes of navigation, s hall be <br />withheld from grant or s ale to priv ate pers ons , partners hips , or c orporations ; prov ided, however, that <br />any s uc h tidelands , reserved to the State s olely for street purpos es , whic h the Legis lature finds and <br />declares are not us ed for navigation purpos es and are not nec ess ary for suc h purpos es may be s old <br />to any town, c ity , c ounty , c ity and c ounty , munic ipal c orporations , private persons, partnerships or <br />c orporations s ubjec t to suc h conditions as the Legis lature determines are nec es s ary to be imposed in <br />c onnec tion with any s uch s ales in order to protec t the public interest. <br />Article 10, Section 4. <br />No individual, partnership, or c orporation, c laiming or poss es sing the frontage or tidal lands of a <br />harbor, bay, inlet, es tuary , or other nav igable water in this State, s hall be permitted to ex clude the right <br />of way to suc h water whenever it is required for any public purpos e, nor to destroy or obs truct the free <br />navigation of s uch water; and the Legis lature s hall enact s uch laws as will giv e the mos t liberal <br />c onstruc tion to this prov is ion, so that acc ess to the nav igable waters of this State shall be alway s <br />attainable for the people thereof. <br />Article 16, Section 6. <br />The Legis lature s hall hav e no power to make any gift, or authorize the mak ing of any gift, of any public <br />money or thing of value to any indiv idual, munic ipal or other corporation whatever. <br />6.1.F. - Page 9
