COUNCILMAN <br /> MURRAY LEFT THE DAIS AT THIS TIME. <br /> ORTLOFF PROPERTY - Initiation of proceedings to condemn a portion of Ortloff <br /> property at the Southeast corner of Jefferson Avenue and Marshall Street <br /> in order to build a downtown parking structure (203-07, 702-12) <br /> Mayor La Berge reminded everyone that this public hearing was continued <br /> unopened from April 13, 1992, and opened the public hearing at 7:40 p.m. <br /> REPORTS: Planning Director, November 12, 1991 <br /> Planning Director, February 10, 1992 <br /> Letter from Curtis M. Luck to Ms. Sheila A. Ortloff, <br /> March 23, 1992 <br /> Community Development Director, April 1, 1992 <br /> Community Development Director, April 14, 1992 <br /> City Attorney Schricker advised that the proceedings before the Council at <br /> this time were for purposes of instituting proceedings of eminent domain <br /> for condemnation of a portion of 702 Marshall Street in connection with the <br /> construction of the downtown parking garage. Notice of this hearing was <br /> given to the owners of the property by letter dated March 23, 1992 and .' .' <br /> notice was also given by letter dated March 14, 1992 from the City . " <br /> Attorney's office to the owners and other parties advising them of the <br /> continuation of the public hearing from April 13, 1992 to April 20, 1992 due <br /> to the requirement of a two-thirds vote for adoption of a resolution of <br /> necessity. City Engineer Luck is to address the necessary points in <br /> adopting a resolution of necessity. The issues before the Council are <br /> 1 i mited to: 1) determination that the public interest and necessity require <br /> the project; 2) the proposed project is planned and located in a manner that <br /> is most compatible with the greatest public good and the least private <br /> injury; and 3) the property sought to be acquired is necessary for the <br /> proposed project. The issue of valuation is not before the Council at this <br /> time. <br /> City Engineer Luck presented the staff report describing the Redwood <br /> City Downtown Parking Structure Study by Wilbur Smith Associates, the <br /> review by the City Centre Revitalization Committee, and the ultimate <br /> decision by the City Council on November 4, 1991 to build the garage on the <br /> Marshall Street site. Mr. Luck described the resulting safety and esthetic <br /> consequences and increased structural costs if the garage were to be built <br /> without utilizing the 4,145 sq. ft. encroachment on the property at 702 <br /> Marshall Street. Mr. Luck described the temporary and long term parking <br /> mitigation measures for the 12 and 1/2 parking spaces located on the subject <br /> property.
