<br /> for his comments. Mr. Patterson advised that the Hawthorne House would not <br /> house developmentally disabled or mentally retarded adults like Kainos Home <br /> and Training Center. Mr. Patterson advised that when Captain Granucci of <br /> the Redwood City Police Department advised there had been no difficulty with <br /> comparable homes he was limiting his comments to licensed facilities. <br /> In response to Councilman Murray's question regarding the definition of a <br /> nursing home, City Attorney Schricker advised that Section 2.72 of the <br /> Zoning Ordinance defines a nursing home as follows: "Shall mean any <br /> premises with less than 15 sleeping rooms where persons are lodged and <br /> furnished with meals, and nursing care." Mr. Patterson advised that this <br /> home will have less than 15 rooms, and under the state licensing the intent <br /> is to provide nursing care as the residents will be in counseling and taking <br /> medication. In response to Councilman Murray's question regarding <br /> compliance with the Land Use Policy L-2 which states: "Residential <br /> neighborhoods should be protected from the encroachment of incompatible <br /> activities or land uses which may have a negative impact on the residential <br /> living environment", Director Patterson advised he did consider that policy <br /> and did not believe that the operation of Hawthorne House at 251 Jackson <br /> Avenue would have a negative impact on the neighborhood. In response to <br /> Council questions Mr. Patterson addressed the issues of screening and of <br /> additional conditions to the Use Permit added in response to neighbors <br /> concerns. The conditions are as follows: <br /> CONDITIONS <br /> 1. That a staff member be present 24 hours per day. <br /> 2. That the four garage parking spaces be used by residents and staff, not <br /> for storage, and that the parking area in front of the dwelling be <br /> reserved for visitors. <br /> 3. That none of the residents admitted to the facility shall have a history <br /> of violence or any conviction of a violent crime. <br /> 4. That this permit be valid for the "Community Living Centers" only and <br /> not be transferable to any other organization. <br /> 5. that an Architectural permit be obtained for any exterior modifications. <br /> 6. That a professionally designed landscape plan be submitted to the City <br /> for review and approval prior to reconstruction of landscape areas. <br /> 7. That there be no signs on the premises identifying this site as a group <br /> living home. <br /> 8. That the elongation of the landing on the easterly side of the rear <br /> building not be permitted, and that an alternative access that does not <br /> encroach on the existing side yard be provided. <br /> 9. That there be no more than 15 mentally ill adults permitted to stay in <br /> the facility at anyone time. <br /> 10. That upon discontinuance of this use or sale of the property, the <br /> building shall be converted to residential dwelling units in a number <br /> and configuration that complies with the parking requirement of the <br /> Zoning Ordinance in effect at the time of sale. <br /> 11.
