6.1.H. - Page 2
ANALYSIS
The Council may accept the provisions of the settlement agreement by directing the City
Manager to deposit the settlement check within 60 days of its issuance or by May 20,
2016. If the Council were not to accept these provisions, the City would forfeit its rights
to the settlement amount of $2,693.72. The California Attorney General has advised in a
letter that she believes this settlement represents a favorable outcome, given that local
agencies are recouping almost two times their estimated losses. Consequently, the City
Attorney's office is recommending acceptance of the settlement provisions and
proceeds.
ALTERNATIVES
Council could elect not to accept the settlement and recoup $2,693.72 in losses.
FISCAL IMPACT
The settlement proceeds will be deposited into the City's general liability fund.
ENVIRONMENTAL REVIEW
This activity is not a project under CEQA as defined in the CEQA Guidelines, section
15378, because it has not potential for resulting in either a direct or foreseeable physical
change in the environment.
FURAH Z FARUQUI
ASSISTANT CITY ATTORNEY
p
MICHELLE MARCHETTA KENYON
ACTING CITY ATTORNEY
MELISSA STEVENSON DIAZ
CITY MANAGER
ATTACHMENTS
1.
