7.B. - Page 7 <br /> WHEREAS, the City has agreed to incorporate in the Project all applicable <br /> mitigation measures identified in the IS/MND and the associated MMRP to reduce <br /> environmental impacts to less than significant levels; and <br /> WHEREAS, the Planning Commission considered the Project's plans and all <br /> environmental documents and supporting studies and reports necessary for <br /> recommending adoption of the IS/MND; by Resolution No. 13-24 the Planning <br /> Commission recommended that the City Council adopt the IS/MND and the MMRP and <br /> approve the Project design; and considered the foregoing at a duly noticed public hearing <br /> on October 15, 2013; and <br /> WHEREAS, the City constructed the storm drain pump station on Bair Island Road <br /> relying on a CEQA exemption and now proposed to construct the joint-use pedestrian and <br /> bicycle path under the U.S. Highway 101 freeway (the "Undercrossing Project"); and <br /> WHEREAS, an Addendum to the Initial Study and Mitigated Negative Declaration <br /> was prepared in April 2016 documenting changes to the Project, analyzing the effects of <br /> new regulations, identifying nearby projects that were not in place when the IS/MND was <br /> prepared and confirming that the IS/MND constitutes an adequate, accurate, objective, <br /> and complete review of the environmental effects of the Undercrossing Project <br /> ("Addendum") and the Addendum found that there was no new significant environmental <br /> effect; and <br /> WHEREAS, the City Council considered the Undercrossing Project's plans and <br /> all environmental documents and supporting studies and reports necessary for adoption <br /> of the IS/MND; considered the Planning Commission's recommendations as established <br /> in Resolution No. 13-24; and considered the foregoing at a duly noticed public hearing <br /> on April 25, 2016. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF REDWOOD CITY, AS FOLLOWS: <br /> A. The IS/MND (attached hereto as Exhibit A) and the associated MMRP <br /> (attached hereto as Exhibit B) are hereby adopted by the City Council based on the <br /> following findings and upon consideration of the Addendum, which was prepared in <br /> accordance with all legal requirements, including CEQA: <br /> 1. The above recitals are true and correct and together with the Staff <br /> Report and the application materials, including without limitation the IS/MND, its <br /> Addendum, and all other documents, reports, studies, memoranda,maps, oral and written <br /> testimony, and materials in the City's file for the application and the Undercrossing <br /> Project, and all adopted City planning documents relating to Undercrossing Project and <br /> the property including the City's General Plan, Zoning Ordinance, and other applicable <br /> City laws and regulations and associated approved and certified environmental <br /> documents, have together served as an adequate and appropriate evidentiary basis for <br /> the findings and actions set forth in this Resolution. <br /> ATTY/RESO.0032/CC RESO US 101 UNDRCROSSING PROJECT <br /> REV:04-21-16 VR <br /> Page 2 of 5 <br />
