Contractor or Contractor's agents, representatives, employees or subcontractors. The insurance <br /> carrier is required to maintain an A.M. Best rating of not less than"A-:IX". <br /> 10.1 Coverages and Limits. Contractor, at its sole expense, shall maintain the <br /> types of coverages and minimum limits indicated below, unless otherwise approved by <br /> City in writing. These minimum amounts of coverage will not constitute any limitations <br /> or cap on Contractor's indemnification obligations under this Agreement. <br /> 10.1.1 Commercial General Liability. Contractor shall maintain occurrence based <br /> coverage with limits not less than $1,000,000 per occurrence. If the submitted <br /> policies contain aggregate limits, such limits will apply separately to the Services, <br /> project, or location that is the subject of this Agreement or the aggregate will be <br /> twice the required per occurrence limit. The Commercial General Liability <br /> insurance policy shall be endorsed to name the City, its officers, agents, <br /> employees and volunteers as additional insureds, and to state that the insurance <br /> will be primary and not contribute with any insurance or self-insurance <br /> maintained by the City. <br /> 10.1.2. Additional Insured: The Commercial General Liability Insurance policy <br /> shall be endorsed to name the City, its officers, agents, employees and volunteers <br /> as additional insureds, and to state the insurance will be primary and not <br /> contribute with any insurance or self-insurance maintained by the City. A copy of <br /> the additional insured endorsement shall accompany Contractor's certificate of <br /> insurance. <br /> 10.1.3. Automobile Liability, including bodily injury and property damage <br /> coverage. Minimum Limits: Contractor shall obtain minimum limits of <br /> $2,000,000.00 each occurrence for all owned, hired, and non-owned vehicles <br /> written on a policy form equivalent to Insurance Services Office coverage form <br /> CA 0001. These minimum limits may obtained by a primary liability policy, <br /> umbrella/excess liability policy, or any combination thereof. For the sake of <br /> clarity, these limits may be obtained under the General Liability Policy described <br /> in Section 10.1.1 above. <br /> 10.1.4. Workmen's Compensation. Contractor shall obtain Worker's <br /> Compensation in accordance with Federal Law and the California Labor Code. <br /> 10.1.5. Waiver of Subrogation: Contractor shall provide a waiver of subrogation <br /> with respect to workers compensation in favor of the City; the endorsement shall <br /> state that the insurer waives any right to subrogation against the City, its officers, <br /> agents, employees and volunteers. A copy of the endorsement shall be attached to <br /> the certificate of insurance. <br /> 10.1.6. Employer's Liability Coverage.
