6.3.A. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> May 9, 2016 <br /> SUBJECT <br /> Resolution of the Council of the City of Redwood City approving a policy regarding <br /> unauthorized berthing at Docktown Marina and approving certain unauthorized berthing <br /> fees and costs <br /> RECOMMENDATION <br /> Adopt the Resolution of the Council of the City of Redwood City Approving a Policy <br /> Regarding Unauthorized Berthing at Docktown Marina and Approving Certain <br /> Associated Unauthorized Berthing Fees and Costs <br /> BACKGROUND <br /> On March 1, 2013, the City assumed management of Docktown Marina following the <br /> decision of the long-term manager to discontinue its management of Docktown <br /> operations. After assuming management of Docktown, the City continued to allow <br /> berthing of boats through berthing licenses and rental agreements. While most Marina <br /> users signed agreements with the City, a few resisted entering into the agreements <br /> and/or stopped paying their rent. <br /> When confronted with marina users who fail to execute berthing licenses or rental <br /> agreements, or who fail to comply with the terms and conditions of an executed <br /> agreement, the City pursues unlawful detainer actions. However, even after successful <br /> unlawful detainer actions, some boats may still remain unlawfully. Additionally, boats <br /> have occasionally arrived at Docktown without authorization and without making any <br /> contact with the City. Staff is seeking to find ways to both remove unauthorized boats <br /> and recover fees associated with any such unauthorized berthing and removal. <br /> ANALYSIS <br /> Staff has prepared a Policy Regarding Unauthorized Berthing at Docktown Marina and <br /> Approving Certain Associated Unauthorized Berthing Fees and Costs ("Policy"). The <br /> Policy establishes a $30.00 per day "unauthorized berthing" fee for boats that are <br /> berthed at Docktown unlawfully or without written consent or authorization from the City. <br /> This fee does not create a right to an authorized berthing. Instead, the purpose of the <br /> fee is to ensure that boats become liable for costs associated with unauthorized use of <br /> and/or removal from Docktown. This is intended to discourage unauthorized berthing <br /> and provide incentives for the owner of a boat in an unauthorized berthing to move <br /> his/her boat from Docktown Marina. <br />
