are determined to be present, construction activities shall not occur within 700 <br /> feet of an identified calling center during the breeding season. If the intervening <br /> distance across a major slough channel (i.e., Belmont Slough) is greater than <br /> 200 feet, then construction may proceed at that location within the breeding <br /> season. <br /> BIO-6.3: If the standard protocol-level survey timing requirements cannot be met, <br /> an alternative survey methodology shall be submitted to the USFW for approval. <br /> The alternative methodology would include a minimum of five surveys, to begin <br /> prior to April 15th, and continuing until one week prior to the start of construction <br /> activities or the end of the breeding season, whichever is sooner. The detailed <br /> alternative methodology must be written by a qualified rail biologist and submitted <br /> to USFW for review and approval. Protocol-level surveys must be completed to <br /> the satisfaction of USFW prior to issuance of demolition or grading permits. If the <br /> alternative methodology is not approved by USFW, the project must implement <br /> the standard methodology as described in BIO-6.2. <br /> Finding: Implementation of Mitigation BIO-6.1 - 6.3 would reduce the project-related <br /> impact of temporary loss of habitat, impacts to breeding, or increased predation <br /> for the California Ridgeway rails during construction to a less than significant <br /> level. <br /> Facts in Support of Finding: These mitigation measures establish a process to identify the <br /> species and its habitat, establish parameters to protect the species during construction, <br /> including avoidance. <br /> Impact: BIO-7: Due to the amount of glass proposed on the building façade and the <br /> number of birds that would be flying though the project site, implementation of <br /> the proposed project as designed could result in an increase in bird mortality or <br /> injury. <br /> Mitigation: BIO-7.1: To the extent feasible, reduce the amount of glass on 1) the two glass <br /> stair towers at the ends of the building, 2) the glass on the Belmont Slough side <br /> of the building, and 3) the glass enclosures on the building's roof, such that the <br /> total area of glass is less than 10 percent of the facades of each of these three <br /> features. Any remaining untreated glazed areas shall be broken up into sections <br /> no greater than 24 square feet in size by mullions or bird-safe glazing treatments. <br /> BIO-7.2: If it is not feasible to reduce the extent of glass to less than 10 percent <br /> on the three building features noted in MM 7-1, bird-safe glazing treatments (e.g., <br /> fritting, frosting, netting, permanent stencils, frosted glass, exterior screens, <br /> physical grids placed on the exterior of glazing, or ultraviolet patterns visible to <br /> birds) shall be used to reduce the extent of untreated glass to less than 10 <br /> percent on each of these features.
