05/09/2016 <br /> 7. Storage Fee: Any Boat removed or secured in place pursuant to Section 6 <br /> of this policy is subject to a Storage Fee of thirty dollars ($30.00) per day. <br /> 8. Costs of Removal: The owner of any Boat removed from Docktown <br /> pursuant to Section 6 of this Policy will be liable to the City for any costs associated with <br /> such removal, including, but not limited, to the City's costs to tow the boat and staff time <br /> required to oversee the towing. <br /> 9. Release: Any Boat that has been removed or secured in place pursuant <br /> to Section 6 will be released only when the owner pays all of the following: (i) all <br /> outstanding Unauthorized Berthing Fees owed pursuant to Section 3 of this Policy; (ii) <br /> all outstanding Storage Fees owed pursuant to Section 7 of this Policy; (iii) all costs of <br /> removal, if any, incurred pursuant to Section 8 of this Policy; and (iv) a seventy five <br /> dollar ($75.00) release fee. <br /> 10. Lien: In order to recoup any and all fees and costs authorized by the <br /> Policy, the City may take any and all steps under any applicable law to establish a lien <br /> upon a Boat that has received an Unauthorized Berthing Notice pursuant to Section 4 of <br /> this Policy and/or been removed or secured in place pursuant to Section 6 of this Policy. <br /> 11. Reservation of Rights: This Policy does not foreclose the City from <br /> taking any action with respect to an Unauthorized Berthing that is otherwise permitted <br /> by law. This Policy does not foreclose the City from taking any action with respect to <br /> persons who own or occupy Boats in Unauthorized Berthings that is otherwise permitted <br /> by law. <br /> 12. No Permission for Unauthorized Berthings: Nothing in this Policy will <br /> be construed to give permission for any berthing that is otherwise an Unauthorized <br /> Berthing. The City will not accept payment of an Unauthorized Berthing Fee except in <br /> connection with the permanent removal of the Boat by its owner from the Unauthorized <br /> Berthing. <br /> 13.
