6.1.B. - Page 2 <br /> In December 2015, Council adopted an affordable housing impact fee program, which <br /> requires developers of specific projects to pay impact fees to offset impacts generated <br /> from the projects. The program includes impact fee alternatives, which include <br /> construction of affordable units at specific percentages based on housing affordability <br /> levels. At this time, the City of Redwood City, like other cities in California, does not <br /> have the ability to adopt a stand-alone inclusionary housing ordinance for rental <br /> buildings due to the Palmer case cited above. <br /> ANALYSIS <br /> To address the ongoing restrictions on affordable rental housing inclusionary polices <br /> and regulations, State Assemblymember Kevin Mullin has cosponsored Assembly Bill <br /> 2502 (AB 2502). This bill would affirm the authority of local jurisdictions to enact <br /> inclusionary housing ordinances, specifically those that would require provision of <br /> residential units affordable to owners or tenants with moderate income, lower income, <br /> very low income, or extremely low income. The bill would clarify that the Costa-Hawkins <br /> rent control law does not apply to inclusionary housing policies and amends the state's <br /> Planning and Zoning law to indicate that inclusionary zoning is an allowable land use <br /> power. <br /> Assemblymember Mullin has requested the City to express support for AB2502. <br /> According to a fact sheet prepared by Assemblymember Mullin's office, other public <br /> agencies supporting the bill include the cities of San Francisco, Belmont, Napa, <br /> Sunnyvale, and Walnut Creek, and the boards of supervisors for Contra Costa County, <br /> the Marin County, Sonoma County, and Los Angeles County. <br /> City staff has prepared a draft letter of support for AB 2502 at the request of Mayor <br /> Seybert. The letter would be forwarded to Assemblymember Mullin's office upon <br /> Council's approval. <br /> ALTERNATIVES <br /> There are no alternatives to the staff recommendation. <br /> FISCAL IMPACT <br /> None. <br /> ENVIRONMENTAL REVIEW <br /> Submittal of a support letter is not a project as defined by the California Environmental <br /> Quality Act. <br /> STEVEN TURNER <br /> PLANNING MANAGER <br />
