Purp�. The purpose of this Agreeraent is to guarantee completion of the Improvements <br /> and ensure satisfactory perfornlance by Developer of Devv�eloper's obligations to satisfy the Co�nditions <br /> pertaining to the Improvoments. <br /> 2. Propertrty Subject to A.,greemont. The Property shall be subject to this Agreemeat. <br /> 3. Du�y ta J�n�tall Imbmvements. Developer will construct,in�tall�ad complote,or causo to <br /> be constructed, inst�lled and completed, at the Devel�er's sole cost and expense, the Impmvements, in <br /> accordance with the Improvement Plans (defined in Recital E. above) aad to the satisfaction of the City <br /> Engin�er,in his reason�ble discretion. Developer will also supply all labor and materials therefor, all in <br /> strict aceor�dance with the terms and conditions of this Agraemcnt. The Improvements shall include,but <br /> are not nccessarily limited to,all of the following: <br /> (a) grading,paving <br /> (b) curbs,gutters,concrete w�lkway�,driveways <br /> (c) sanitary sewer system,complet� <br /> (d) water s�st�m,complete <br /> (e) storm drainage system,complete <br /> (fj site lighting system,complete <br /> (g) street trees <br /> (h) landscaping and irrig�tion system complete <br /> (i) utility joint trenching <br /> (j) all Conditions of the Tentative Map <br /> (k) and all other work, improvements, or constru�rion required by or specificd in the <br /> abovementioned plan�and spccifxcatioas, canditions of penriit� aad all constructioa, <br /> appurtenances and improvements aecessary as reasasa�ble determined by the City <br /> Engineer to complete the aforementioned improvements, both within and outside of <br /> the Property. <br /> The con�truction, in,stallation �..nd cornpletion of the Improvemeats and all labor and materials furnishcd <br /> in canaectian therewith are hcrcinafter refernd to collectively as the "Work."
