7.D. - Page 5 <br /> complete. Developers providing art on-site will submit a detailed Public Art Permit <br /> application prior to issuance of a building permit. The Civic Cultural Commission will <br /> review the application and recommend approval or disapproval to the City Manager. <br /> The City Manager will have final approval authority for Public Art Permits. On-site art <br /> must be installed in conformity with an approved Public Art Permit before a certificate of <br /> occupancy will be issued. <br /> Developers electing to pay an in-lieu fee must pay the fee prior to issuance of a building <br /> permit. The in-lieu fee will be in an amount equal in value to one percent of the project's <br /> construction valuation or, if the developer is providing some art on-site, the in-lieu fee <br /> will be equal to the difference between one percent of the project's construction <br /> valuation and the value of the art to be provided on-site. <br /> ALTERNATIVES <br /> The City Council could consider several alternative approaches, including: <br /> 1. Directing staff to conduct further research. <br /> 2. Assessing a lower or higher percentage on the Capital Outlay Fund for public art. <br /> 3. Assessing a lower or higher percentage on commercial development projects for <br /> public art. <br /> 4. Consider other methods of funding public art. <br /> 5. Decline to designate a source of fund for public art. <br /> FISCAL IMPACT <br /> The amount contributed from the Capital Outlay Fund to the Art in Public Places Fund <br /> will vary from fiscal year to fiscal year. Had the one percent requirement been in place <br /> for FY 2016-17, over $80,000 would have be transferred to the Art in Public Places <br /> Fund. If private developers choose to pay an in-lieu fee rather than providing art on site, <br /> that will further increase the funds available in the Art in Public Places Fund. <br /> ENVIRONMENTAL REVIEW <br /> This project is exempt from CEQA pursuant to Section 15061 of the CEQA guidelines <br /> because it can be seen with certainty that there is no possibility that passage of this <br /> ordinance will have a significant effect on the environment. <br /> CHRISTOPHER BETH <br /> DIRECTOR <br /> PARKS, RECREATION AND COMMUNITY SERVICES <br />
