7.D. - Page 12 <br /> be removed, altered, or changed without the prior review and advice of the Civic Cultural <br /> Commission and the approval of the City Council. <br /> Sec. 45.060 Standards for Review. <br /> In evaluating proposed art in public places to be funded by the Art in Public Places Fund, <br /> the Civic Cultural Commission and City Council shall give special attention to the <br /> following: <br /> A. The artist is required to have experience in and/or knowledge of the type of art <br /> proposed for installation and public viewing. The artist's qualifications will be evaluated <br /> and examples of past work may be reviewed to determine whether or not the artist has <br /> appropriate experience for the project; <br /> B. Appropriate locations may include, but are not limited to, vehicular entryways to <br /> the property, plazas, greenbelts and building façades. The location selected should allow <br /> reasonable accessibility to the art. The location shall be exterior and installation of the art <br /> piece shall enhance the art and allow for unobstructed public viewing from as many <br /> angles as possible; <br /> C. The art shall be proportional to the scale of the development and designed to <br /> create an artistic, visual, and aesthetic impact upon observers. Particularly in locations <br /> on major thoroughfares and major intersections, the art should be of such size and nature <br /> as to strengthen the urban design and aesthetic quality of life in the community; <br /> D. The art shall be conceptually compatible with the immediate environment of the <br /> site; appropriate to the function of the site; and compatible within any unified design <br /> character or historical character of the site; <br /> E. Appropriateness of the materials, textures, colors, and design to the expression <br /> of the design concept; <br /> F. Representation of a broad variety of tastes within the community and the <br /> provision of a balanced inventory of art in public places to insure a variety of style, design, <br /> and media throughout the community that will be representative of the eclectic tastes of <br /> the community; and <br /> G. Preservation and integration of natural features with the project. <br /> Sec. 45.070 General Rules for Art in Public Places. <br /> A. Private Sites for Art in Public Places. No work of art financed or installed either <br /> wholly or in part with City funds or with grants procured by the City shall be permanently <br /> installed on privately owned property without a written agreement between the City and <br /> the owner specifying the proprietary interests in the work of art, binding the owner to the <br /> general rules for art in public places, and specifying other provisions deemed necessary <br /> or desirable by the City Attorney.
