6.1.B. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> June 13, 2016 <br /> SUBJECT <br /> Public Access Easement Deed granted by FSDW-Redwood City, LLC for the property <br /> at 2808 El Camino Real <br /> RECOMMENDATION <br /> By motion, approve the Public Access Easement, and authorize the City Manager to, <br /> upon receipt of a signed Deed, accept the Public Access Easement Deed granted by <br /> FSDW-Redwood City, LLC for the property at 2808 El Camino Real, execute the <br /> Certificate of Acceptance for such Deed, and modify the content of the Easement Deed <br /> as necessary to receive signed Deed <br /> BACKGROUND <br /> On May 21, 2013 the Planning Commission approved the Architectural Permit and Use <br /> Permit for the Kensington Assisted Living Facility Project at 2808 El Camino Real under <br /> Resolution No. 13-10. The project includes the construction of a new 36,000 square <br /> foot, two-story, 45-unit assisted care facility, and new right-of-way improvements along <br /> Oakwood Blvd and El Camino Real. A condition of approval for the project requires a <br /> dedication for use of the sidewalk on El Camino Real along the entire property frontage. <br /> ANALYSIS <br /> The improvement plans were reviewed and approved for the development, and the <br /> easement area is based on the full sidewalk area along El Camino Real that is not <br /> currently in the right-of-way. Accepting the dedication of the Public Access Easement <br /> will allow pedestrians the use of the sidewalk area for as long as the City chooses to <br /> hold the easement area. <br /> The easement deed presented for approval limits its purposes to the use for the right of <br /> ingress and egress for public purposes. This will meet the City's current needs for the <br /> use of the sidewalk and ensure that the area remains free of structures. <br /> ALTERNATIVES <br /> Council may choose not to accept the sidewalk dedication, which would limit the future <br /> design of the right-of-way improvements. <br /> FISCAL IMPACT <br /> There is no fiscal impact to the City as a result of this action. <br />
