The <br /> violation of the construction and maintenance obligations of this Chapter is hereby <br /> declared to be a public nuisance which may be abated as provided by law. <br /> Sec. 45.140 Regulations. <br /> The City Council and/or City Manager may adopt administrative regulations or procedures <br /> to administer this Chapter, including procedures for selecting sites, artists and art works <br /> to implement this Chapter." <br /> SECTION 3. Severability. If any sections, subsections, sentences, clauses, <br /> phrases or portions of this Ordinance are for any reason held invalid or unconstitutional, <br /> such decision shall not affect the validity of the remaining portions of this Ordinance. The <br /> City Council hereby declares that it would have passed this and each section, subsection, <br /> phrase or clause of this ordinance whether or not any one or more sections, subsections, <br /> phrases or clauses may be declared invalid or unconstitutional on their face or as applied. <br /> SECTION 4. CEQA. The City Council finds that the proposed ordinance is exempt <br /> from the provisions of the California Environmental Quality Act pursuant to Section 15061 <br /> of the CEQA Guidelines because it can be seen with certainty that there is no possibility <br /> that passage of this ordinance will have a significant effect on the environment. Staff shall <br /> file a Notice of Exemption with the County Clerk pursuant to CEQA Guidelines Section <br /> 15062. <br /> SECTION 5. The City Clerk shall publish this Ordinance in accordance with <br /> applicable law. <br /> SECTION 6.
