ATTY/AGR/2016.171/ZOPPE LIVE PERFORMANCE <br />REV: 06-29-16 RL <br />Page 1 of 11 <br />LIVE PERFORMANCE AGREEMENT <br />(Zoppé Family, Inc.) <br /> <br />This Agreement is made and entered into as of the day of , 2016, <br />by and between the City of Redwood City, a charter city and municipal corporation of the <br />state of Calif ornia( “City”), Kerby Lovallo of New World Classics, an artist management <br />company (“Agent”) and Zoppé Family, Inc., an Italian Theatrical Circus, (“Performers”) <br />(collectively, the “Parties”). <br /> <br />RECITALS <br /> <br />A. Performers are a family owned Italian Theatrical Circus founded in 1842. <br /> <br />B. In 2008, 2009, 2010, 2011, 2012, 2013, 2014 and 2015 the Parties entered <br />into agreements bringing Zoppé Circus performances to Redwood City, which have <br />received satisf actory levels of patronage. <br /> <br />C. The City desires to sponsor the return of Zoppé Circus to Redwood City to <br />perform up to 30 shows in October 2016. Hosting the event provides the public benefit of <br />bringing activity and commerce to the Redwood City area. <br /> <br />D. Agent is a classical arts manager, who will secure Performers’ services on <br />behalf of the City. <br /> <br />E. The City is entitled to all ticket sale revenues resulting from Performers’ <br />shows. <br /> <br />NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, the Parties agree as follows: <br /> <br />1. Services. Performers agree to provide performances to be held in a one- <br />ring circus tent, starring Nino the clown, with acrobatics, equestrian showmanship, canine <br />capers, clowning, and audience participation (“Performances”), the dates, times, and <br />locations of which are more fully described in Exhibit “A.” <br /> <br />2. Place of Performances. The Performances will take place in Red Morton <br />Park, located on Valota Road near the Veterans Memorial Senior Center in Redwood City <br />(the “Place of Performance”). <br /> <br />3. Schedule of Performances. The Performances will take place pursuant to the <br />schedule set forth in Exhibit “A” (the “Schedule of Performances”). <br /> <br />4. Compensation.
