7 <br /> <br />As discussed in the Background section of this report, the DTPP contains development <br />Standards (which are mandatory), and Guidelines (which are recommended.) Projects <br />within downtown must comply with all standards, but may request deviations from the <br />recommended guidelines. As the DTPP states at page 25: <br /> <br />“In various cases, the Guidelines provide a choice of treatments that will <br />achieve the desired effect, and any one may be selected. Although direct <br />conformance with the Guidelines is the surest route to swift approval, <br />developers are permitted to propose alternative design details if they are <br />able to show that such details implement the overall Plan objectives with <br />respect to the desired character of the Downtown.” <br /> <br />The 603 Jefferson Project complies with all DTPP mandatory standards and all but five <br />of the recommended guidelines. The five guideline deviations were appropriately <br />reviewed as described in the Planning Commission report and further described below. <br /> <br />ii. The Project Meets All Applicable Mandatory Standards and All But Five <br />Recommended Guidelines, for Which Deviations May Appropriately Be <br />Approved by the City. <br /> <br />As discussed in detail below, the Project is consistent with the DTPP and advances <br />numerous DTPP policies, and the City has ample discretion to approve minor Project <br />deviations from DTPP guidelines. <br /> <br />As the Planning Commission staff report explains and the Planning Commission found, <br />the Project satisfied all required City review and approval processes including the <br />HRAC and AAC review, and Planning Commission approval. Further, the Project meets <br />all applicable DTPP standards, and satisfies all but five recommended guidelines, for <br />which permitted deviations may appropriately be approved, as they were recommended <br />by the AAC and approved by the Planning Commission. The five requested guideline <br />deviations pertain to the size of the ground floor commercial tenant space(s), tandem <br />parking spaces, and minor architectural details. Details on the requested deviations <br />were described earlier in the Background section of this report. <br /> <br />Thus, staff recommends denial of the appeals and approval of the Project, as further <br />discussed below. <br /> <br />b.
