510 ALLERTON STREET FROM FAMILY UffELLING UNITS TO PROFESSIONAL OFFICE UNITS. The Clerk read the letter <br />su5mitted by the Planning Commission dated October 24the Mr. Lester Brown spoke in favor of the permit. <br />He believes that this will be an improvement of the existing construction. He presented a petition signed <br />by 14 property owners in the neighborhood and they feel that this will not be detrimental to the surrounding <br />area. Mr. Brown stated what he planned to do with the building and the extent that the building would be <br />remodeled. This was followed by discussion. In answer to a question, Mr. Brown stated that the two story <br />building in the rear will be torn down for parking purposes. Mr. Fred Hamilton, real estate man, presented <br />it <br />a copy of the termite inspection of the premises to the Council for their inspection. Building Inspector <br />Kreiss stated that this was in the ##1 Fire Zone. He was of the opinion that this building could not be <br />remodeled to comply to the Fire restrictions. He stated further that there etre 113 other dwelling buildings <br />W in this area. Mr. Kreiss stated that he did not believe that they could reconstruct this building to fit <br />LO the Fire Zone No. 1 restrictions. <br />Fire Chief Lodi spoke on the subject and stated the situation and why the zoning effected the balance of the <br />City. At the present time the City is classified as a No. 3 City. He explained the object to number 1 fire <br />Tones. If the Council allows the change of the building and its use then the Fire Department is against <br />the change of the building because of the Fire zoning. This was followed by further'discussion in regard <br />to the use of the building and the soundness of the building. Mr. Brown stated that if the Council found <br />it necessary he would be glad to give the City a covenant in whichthey will cease use of the building in <br />10 years. This was followed by discussion in regard to having the use permit comply with the building code. <br />Councilman Spillers moved that the public hearing be closed, seconded by Councilman Herkner and carriede <br />Councilman Granger questioned the need of any further action by the Council. Councilman Spillers moved <br />approval of the use permit, any construction topb be in conformance of the Fire zone and 1952 Uniform Building <br />Code, seconded by Councilman Weiss. This was followed by discussion. The motion lost on roll call with <br />Councilman Britschgi, Granger, Herkner voting No and Councilman Stout being noted absent. <br />TRAFFIC C OMMITTEE REPORT REGARDING RECENT CHANGES OF FA RKING ON ITINSLOW AND HAMILTON STREETS. The Clerk read <br />the letter wherein the traffic committee recommended that all parking remain parallel and stated their <br />reasons for their dicision. A representative group of merchants from the Winslwo Street and Hamilton Street <br />areas was present to protest the recent changes made on these two streets. Mr. Cuthrie Burt spoke for the <br />merchants. It was the general opinion of the group that parallel parking is good planning but they feel <br />that this isn't the time to start. They argued in favor of returning to diagonal parking, especially <br />during the Christmas Holidays. This was followed by a very lengthy discussion Councilman Spillers moved that <br />the City Attorney draw up an amendment to the ordinance for diagonal parking on Hamilton and Winslow streets <br />for 60 days, seconded by Councilman Britschgi. This was followed by discussion in which the merchants <br />stated that they did not want this for only 60 days. Councilman Spillers changed his motion and left off the <br />60 days time limit. The motion carried. <br />There was considerable discussion in regard to whether or not this should be considered and emergency <br />ordinance. Councilman Granger offered a resolution to declare this an emergency ordinance. The City <br />Attorney stated that the first action should be to rescind the previous motion and then have the City <br />Attorney prepare an emergency ordinance allowing diagonal parking on Winslow and Hamilton Streets. Council— <br />r" man Granger withdrew his motion and moved approval of the City Attorney suggestion,ssconded by Councilman <br />Herkner and carried on roll call, Councilman Stout being noted absent. <br />ATTORNEY LEBSACK REPORT REGARDING REQUEST FOR SEGREGATION AND AN APPORT ONMENT OF DIAGRAM ASSESSMENT NO. 8, <br />RESOLUTION NO. 17802 INDUSTRIAL WAY. The Clerk read the letter which outlined the procedure for the Council <br />to take in regard to segregation of the above mentioned assessment 8. The action of the Council for tonights <br />meeting would be to order the street superintendent, by motion, to make an amended assessment and report <br />and to file it with the clerk. Councilman Spillers moved approval of the report and authorized to Street <br />
