x_04 <br />Minutes of the Regular Adjourned Meeting <br />REI7IVOCD CITY COUNCIL <br />March 26, 1956, 8:00 P.M. <br />Invocation was lead by Reverend Ralph Benson, North Fair Oaks Community Church. <br />ON ROLL CALL the following were noted present: Councilmen Paul Jones, William H. Royer, Robert V. Spillers, <br />Hiram S. Stout, Mayor Sidney D. Herkner and City Clerk R. S. Dodge. Councilmen Carl A. Britschgi and <br />Floyd D. Granger were noted absent. Also present were City Manager E. A. Rolison, City Attorney C. B. <br />Currie, City Engineer Glenn M. Jain, Water Superintendent H. L. Winter, Fire Chief J. L. Lodi, Building <br />Inspector S. H. Kreiss, Assistant to City Manager L. A. Kimball, Assistant Water Superintendent Warren <br />Mitchell, Acting Police Chief Theodore Moudakas, Assessor Auditor John J. Brophy, Planning Commissioner <br />Carl Sjoberg, Park and Recreation Commissioners Louise Tornell and Wm. Hanley and Account -Clerk Vivian "4 <br />Holmquist. <br />The minutes of March 5, 12 and 19, 1956 were approved as mailed on motion of Councilman Spillers, seconded by <br />Councilman Royer and carried. <br />PUBLIC HEARING ON PROTEST OF PLANNING COPWSSION GRANTING OF USE PERMIT AND RECOW=ING VARIANCE TO DR. L. N. <br />MELEYCO (WOODSIDE ROAD AND NIMITZ). Affidavit of mailing was ordered filed. The Clerk read a letter <br />frau Mrs. Margaret Coats wherein she stated that the permit should be allowed. The Clerk also read the <br />Planning Commission's recommendation, and the letter of protest from Mrs. Vera Eskin. The following <br />people talked at some length against the granting of the use permit: Mrs. Vera Eskin, 2711 Delaware <br />Avenue and also representing the Green Knolls Improvement Club, Mr. M. S. Olson, 104 Nimitz Avenue, <br />Constance Bozzo, 125 Nimitz Avenue, Jane Logan 363 Nimitz Avenue, Paul Potocek, 134 Nimitz Avenue and <br />A. C. Amos, 130 Nimitz Avenue. Dr. Meleyco spoke on his own behalf. This was followed by a very lengthy <br />discussion. In the main the residents based their protests on charges that the proposed use would �. <br />constitute spot zoning, that it would add to traffic dangers and further confuse the parking situ tion. <br />Councilman Spillers moved that the public hearing be closed, seconded by Councilman Royer and carried. <br />Councilman Jones moved to overrule the Planning Commission and derby the use permit because of spot zoning, <br />seconded by Councilman Stout who stated that he was seconding the motion because of the narrownes of <br />Nimitz. The motion carried. City Attorney Currie stated that some action should be taken in regard to <br />the variance. Councilman Britschgi moved to deny the variance, seconded by Councilman Spillers and <br />carried. <br />Councilman Spillers moved to have this matter referred to the Traffic Fact Finding Committee for <br />consideration in regard to possibility of signals, seconded by Councilman Royer Councilman Granger <br />questioned if this was a County problem or a City problem. Councilman Spillers stated that the City <br />should make a survey and then turn the matter over to the County for their consideration. Motion carried. <br />Councilman Stout was of the opinion that the Planning Commission should indicate to the Council what they <br />intend to do on Woodside Road and he so moved, seconded by Councilman Jones. This was followed by <br />discussion after which the motion carried. <br />STULSAFT COMMITTEE REPORT, VINCENT RAMBO, CHAIRL0. The Stulsaft Park Committee, at its last meeting, <br />decided that continued deliberations concerning the proposed childrens' story world park would be futile <br />without additional tecknical information pertinent to the site. Consequently, further meetings will not <br />be held until at least preliminary master plan data becomes available. Mrs. Vera Eskin has been - <br />appointed to keep in touch with the firm drafting the plan so that prompt use can be made of their <br />findings. <br />Councilman Stout wanted to know how soon something could be done and he also wanted to know what progress <br />has been made in the master plan. City Engineer Jain stated that he thought that May 1st was the date tht <br />the plan was to be completed. <br />
