94 <br /> Councilman Spillers appeared in the meeting at 8:20 p.m. Councilman Stout seconded the <br /> motion which carried. <br /> PUBLIC HEARING ON PLANNING COMMISSION'S RECOMMENDATION TO DENY APPLICATION OF J. E. CRAWFORD <br /> (140 Roosevelt Avenue) TO REZONE PORTION OF LOT 4, BLOCK B, W. W. & M. SUBDIVISION, <br /> FROM R-4 TO C-1-H. The Planning Commission refused to recommend approval of the <br /> extension of a C-1 Zone, particularly in view of the statements made by the applicant <br /> that he only wished to reduce required setback for an apartment development. There <br /> being no protests, written or oral, Councilman Stout moved that the public hearing be <br /> closed, seconded by Council man Weymouth and carried. <br /> Councilman Stout moved that the Planning Commission recommendation be approved to deny <br /> the rezoning, seconded by Councilman Weiss. This was followed by discussion in regard <br /> to the location of the property. The motion carried with Councilman Spillers voting NO. <br /> COUNCILMAN HERKNER REPORT REGARDING GARBAGE CONTRACT. Councilman Herkner stated that the <br /> Committee met again with the San Mateo County Garbage Company r epresentatives to go over <br /> the suggested agreement referring to a new proposed ordinance. A few changes were <br /> suggested and the rates are subject to arbitration at the start of each fiscal year. <br /> The contract is now being drawn u > by the City Attorney who is meeting with the Garbage <br /> Company' s representatives. Councilman Spillers moved that this matter be referred to <br /> the City Attorney and the Committee' s report be accepted, seconded by Councilman Granger. <br /> r. <br /> Councilman Weiss moved an amendment to the motion that a draft of the contract be given <br /> to the Council before it is signed. The Mayor asked if this could be made a part of the <br /> motion rather than an amendment. This was agreed to by Councilman Weiss and the maker <br /> of the motion. The motion carried. <br /> ma <br /> CITY MANAGER ORAL REPORT ON THE TRAFFIC SURVEY. The City Manager stated that the Traffic <br /> Survey is now before the Planning Commission for a study meeting. They will set the <br /> matter for a public hearing after which it will be presented to the Council at the same <br /> time that the Land Use Plan is to be turned over to the Council. <br /> REPORT ON BID OPEdING, STREET RESURFACING. The following bids were received: <br /> Name Alternate No. 1 Alternate No . 2 <br /> Daytime Work on Night or Sunday Work on <br /> all Streets . Broadway, Daytime work <br /> on all other streets. <br /> Bragato Paving Co. 155 9115,560 .30 <br /> Sondgroth Bros . 15,067.35 15,828.35 <br /> Freeman Paving Co. 16,017. 61 16, 778.61 <br /> L. C. Vistica a Son 18,386.50 19,4.13.85 <br /> Engineer' s Estimate 18, 872.00 19,633.00 <br /> The City Engineer recommended that the low bid of Bragato Paving Co. be accepted, <br /> Alternate No. 2, for paving Broadway during night time or Sunday hours, and all other <br /> streets during regular daytime hours. This was concurred in by the City Manager. <br /> Councilman Granger moved approval of the City Engineer' s recommendation to accept the low <br /> bid of Bragato Paving Co. and rejected all other bids, seconded by Councilman Spille:s. <br /> Councilman Herkner stated that he was of the opinion that the work should be done during <br /> daytime rather than at night when it is too dark to do the work without proper lighting <br /> equipment. He preferred having the work done on Sunday rather than having the work done <br /> at night time. This was followed by considerable discussion as to when would be the best <br /> time for everyohe to have the work done, Sunday or night time for Broadway. The Police <br /> Chief and the City Engineer preferred having the work done on Sunday if it was possible. <br />
