435 The City Attorney read the proposed ordinance delaying the effective date of ordinances 813 and 844 and calling for the matter to be placed on the ballot in April, 1958, or sooner if the Council desires. Councilman Spillers offered introduction of ordiance, seconded by Councilman Herkner. Councilman Granger questioned the date of the election. The Mayor told the people in the audience that Palo Alto received $225,000 for the quarter from October through December. The motion carried on roll call with Councilman Weymouth and [:: Mayor Royer voting NO and Councilman Weiss being noted absent. - Councilman Spillers offered RESOLUTION 2205 AUTHORIZING ADVRTISEMENT FOR BIAS AND LEASE TO SCHOOL DISTRICT, PORTION OF LOT 8 (HAWES PARK) W. W. & M. SUBDIVISION, and moved its adoption, seconded by Councilman Weymouth and carried on roll call, Councilman Weiss being noted absent. ON ROLL CALL the following were noted present: Councilman Floyd D. Granger, Sidney D. Herkner, Robert V. Spillers, Hiram S. Stout, Ray Weymouth, Mayor William H. Royer and City Clerk R. S. Dodge. Councilman Louis Weiss was noted absent. Also present were City Manager E. A. Rolison; City Attorney Robert J. Costello, City rpm g¢ Engineer Glenn M. Jain, Water Superintendent H. L. Winter, Assistant Water Superintendent Warren Mitchell, Building Inspector S. H. Kreiss, Police Chief William Faulstich, Fire Chief J. L. Lodi, Planning Commissioner Greenwold and Senior Stenographer-Clerk Vivian Holmquist. Councilman Stout moved approval of the minutes of March 18th and March 25th as mailed, seconded by Councilman Spillers and carried. ADOPT ORDINANCE SUSPENDING OPERATION OF SALES AND USE TAX ORDINANCE 843 AND 844. The affidavit of publication was ordered filed. ' Councilman Spillers offered ORDINANCE 852, AN ORDINANCE OF THE CITY OF REDWOOD CITY PROVIDING FOR AN ELECTION ON THE QUESTION OF WHETHER R NOT LOCAL SALES AND USE TAXES SHALL BE LEVIED BY THE CITY CF REDWOOD CITY AO SUSPENDING THE OPERATION OF ORDINANCE NO. 843 (LOCAL SALES TAX) AND ORDINANCE NO. 84 (LOCAL USE TAX) and moved its adoption, seconded by Councilman Herkner. The Clerk read the title of the ordirr nce. Councilman Granger stated t hat he wanted the minutes to show that he was of the opinion that the sales tax is the only equitable way for the City to obtain the needed revenue. He was only going along with this ordinance because it would give the people a chance to vote on the matter. The Mayor asked the City Attorney questions in regard to the motion. He asked Mr. Davies if the people voted in favor of taking the affir- mative on the tax, would he file the petition on the Charter. Mr. Davies stated that he will not file the petition if that is the wish of the people. Mr. Davies indicated that he will keep the petitions himself in answer to the question raised by Councilman Granger. Der. Lebsack stated that he had inquired about a .o title company holding the petitions and they indicated they did not desire to act as a depository. This w as followed by discussion. The motion carried on roll call with Councilman Weymouth and Mayor Royer voting NO and Councilman Weiss being noted absent. City Manager Rolison stated that it was his opinion that the $1.00 deposit should be refunded to the merchants who paid the fee for the sales tax permit.
