They will probably do some seal <br /> coating in the near future on this particular street. <br /> CONSIDERATION OF BIDS, CITY DUMP. The following bids were received: <br /> Frank Benevento $10.00 a month to the City <br /> Henry G. Rafter - $202.00 a month to the City <br /> In his letter, the City Manager stated that Mr. Rafter had requested that his bid be rescinded, due to the <br /> rm: fact that he is unable to comply with the bond and insurance requirements. He recommended that the bid of <br /> Frank Benevento be accepted. <br /> The Clerk read the letter fram Mr. Rafter asking that his bid be rescinded due to their inability to secure <br /> necessary financing and equipment. The City Engineer stated that Mrs. Rafter called and stated that they did <br /> (:: not want the bid. The City Manager asked that City Clerk to read the letter from Leslie Salt Company. <br /> Before the letter was read, Councilman Herkner wanted to know if the bidder had put in a bid bond. This <br /> was followed by discussion. Councilman Spillers moved to accept the bid of $10.00 and he offered RESOLUTION <br /> 2207 AWARDING THE DUMP BID TO FRANK BENEVENTO and moved its adoption, seconded by Councilman Weymouth and <br /> carried on roll call, Councilman Weiss being noted absent. <br /> EMPLOYMENT OF ATTORNEY FOR MARSHALL STREET IOW/VENTS. The Clerk read the letter of the City Manager herein he <br /> stated that the City Engineer advises that an attorney should be appointed by the City Council to conduct <br /> assessment proceedings for the improvement of Marshall Street adjacent to Parking Lot VI. Plans and <br /> specifications are now being prepared by Mr. Paul Adamson for this project, and contract and other legal <br /> documents are needed, since this portion of Marshall Street is to be improved under separate proceedings. <br /> Councilman Stout asked if this was because our City Attorney could not do the work. The City Attorney <br /> stated that he could do the work but he would have to let some otherwork go. He further stated that after <br /> he did the work there was still the chance that the bonding company would not accept the opinion of the full <br /> time City Attorney. Councilman S Spillers moved approval + <br /> p' pproval of the City Manager's recommendation, seconded by <br /> Councilman Weymouth. After considerable discussion, Councilman Spillers restated his motion and moved <br /> approval of the City Manager's recommendation and the City Manager be authorized to hir Currie & Leheack as <br /> attorneys at a fee of 2%. This was followed by more discussion. The City Manager recommended approval of <br /> the 2% fee. The motion carried unanimously. <br /> CITY ENGINEER RECOMMENDATION REGARDING EXTENSION OF 20 WORKING DAYS TO E. T. HAAS, HIGHLANDS OF EMERAL LAKE NO. <br /> 1 IMPROVEMENTS. The City Engineer recommended granting the extension due to delays caused by weather, <br /> acquisition of right-of-way and otherunforseen conditions. Councilman Herkner moved approval of the request, <br /> seconded by Councilman Spillers and carried. <br /> PENINSULA HUMANE SOCIETY PROPOSE AN ORDINANCE PROVIDING PROTECTION FOR BIRDS AND ANIMALS. The Clerk read the <br /> letter from the Humane Society and also their proposed ordinance. Councilman Granger referred this matter <br /> to the City Manager for his recommendation, seconded by Councilman Spillers and carried. <br /> rims <br /> Lii, APPLICATION FOR DANCE PERMIT, BEAUTICIAN SORORITY, APRIL 14, 1957. The Clerk read the application. The dance <br /> would be held in the American Legion Hall between the hours of la P. M. to 9 P. M. on April ]4th. The Police <br /> Chief recommended approval of the permit. Councilman Spillers moved that the permit be granted, seconded <br /> by Councilman Stout and carried. <br /> rm. PLANNING COMMISSION RECOMMENDED APPROVAL OF THEIR INITIATIVE TO REZONE FROM R-2 TO R-3 DISTRICT ALL OF THE LANDS <br /> WHICH ARE NOW R-2 WITHIN THE AREA BOUNDED BY HUDSON STREET, POPLAR AVENUE, HESS ROAD AND THE REAR OF THE <br /> PROPERTY FRONTING WOODSIDE ROAD. The Planning Commission feels that these additional R-3 areas are <br /> necessary for the beat development of the city, and are in conformity with the proposed Land Use Plan. <br /> Councilman Herkner moved to set this matter for public hearing in two weeks, Aprill5th, seconded by <br /> Councilman Stout and carried. <br /> 1 <br />
