the School Site Portion of the Property as well as portions of the Adjacent Property, and this <br /> Agreement is being recorded against the entirety of the Property and the Adjacent Property, all as <br /> described on Exhibit "A-4", attached hereto and incorporated by this reference as if fully set forth <br /> herein, in recognition of such requirement; and <br /> D. Attached hereto as Exhibit `B", and incorporated herein by this reference, is a <br /> legible reduced-scale copy of the site plan showing the stormwater treatment measures that are to <br /> be located or to be constructed on the School Site Portion of the Property (with a portion thereof <br /> also being located on the Adjacent Property), hereinafter referred to as the "Site Plan"; and <br /> E. Attached hereto as Exhibit "C" and incorporated herein by this reference, is an <br /> "Inspection and Maintenance Checklist" which describes the Property Owner's maintenance <br /> activities to be performed pursuant to this Agreement; and <br /> F. The City is the permittee public agency with jurisdiction over the Property (and the <br /> Adjacent Property); and <br /> G. The Property Owner recognizes that the stormwater treatment measure(s) more <br /> particularly described and shown on Site Plan, of which full-scale plans and any amendments <br /> thereto are on file with the Engineering & Transportation Services of the City of Redwood City <br /> must be installed and maintained as indicated in this Agreement and as required by the NPDES <br /> Permit or other regulatory agencies having jurisdiction; and <br /> H. The City and Property Owner agree that the health, safety and welfare of the <br /> citizens of the City require that the stormwater treatment measure(s) detailed in the Site Plan be <br /> constructed and maintained on the School Site Portion of the Property (and the Adjacent Property, <br /> to the extent located thereon); and <br /> I. The City' s Stormwater Management Ordinance, Stormwater related guidelines, <br /> criteria and other written directions ("City Stormwater Regulations") require that the stormwater <br /> treatment measure(s), as shown on the approved Site Plan, be constructed and maintained by the <br /> Property Owner. <br /> AGREEMENT <br /> NOW, THEREFORE, in consideration of the benefit received by the Property Owner as a <br /> result of the City's approval of the Site Plan, the Property Owner hereby covenants and agrees <br /> with the City as follows: <br /> L . Construction of Treatment Measures. The on-site stormwater treatment measure(s) <br /> shown on the Site Plan shall be constructed by the Property Owner in strict accordance with the <br /> approved plans and specifications identified for the School Site Portion of the Property (and the <br /> Adjacent Property, to the extent applicable) and any other requirements thereto which have been <br /> approved by the City in conformance with City Stormwater Regulations. With respect to the <br /> stormwater treatment measures to be located on the School Site Portion of the Property, prior to <br /> the conveyance of the School Site Portion of the Property to OAI, COA and OAI shall be jointly <br /> and severally liable for the performance of the duties and obligations of the Property Owner <br /> hereunder with respect to such stormwater treatment measures, and following such conveyance <br /> ATTY/AG R/2016.160/CENTRU M OWNERS ASSOCIATION-STMMA <br /> REV: 06-22-1615 <br /> Page 2 of 9 <br />
