<br />WHEREAS, two appeals were filed with the City during the 15-day appeal period
<br />by (1) Carr, Yeley and Associates, and (2) Kris Johnson challenging the Planning
<br />Commission’s approval of the Project; and
<br />
<br />WHEREAS, the matter was duly noticed for a de novo public hearing before the
<br />City Council on July 25, 2016; and
<br />
<br />WHEREAS, on July 25, 2016 the City Council conducted a duly noticed de novo
<br />public hearing in accordance with all applicable requirements of the Subdivision Map
<br />Act and the Redwood City Municipal Code, all applicable requirements of the State
<br />Planning and Zoning Law, the City Zoning Ordinance and the Downtown Precise
<br />Plan, to consider the appeal of the Project, and received and considered oral and
<br />documentary evidence on the appeals and application; and
<br />
<br />WHEREAS, the City Council considered the Initial Study checklist prepared by
<br />the City's Planning Division and its findings, the previously certified Downtown
<br />Precise Plan Program EIR (State Clearinghouse #2006052027), and the entire
<br />record of the administrative proceedings regarding the adoption of the Downtown
<br />Precise Plan (including without limitation the Mitigation, Monitoring and Reporting
<br />Plan attached to Resolution No. 15086 adopted on January 24, 2011); and
<br />
<br />WHEREAS, the City Council determined that the proposed Downtown
<br />Planned Community Permit including five guideline deviations, Tentative Map,
<br />Condominium Permit, and Planned Development Permit would further the purposes
<br />of and appropriately implement the City of Redwood City General Plan, the
<br />Downtown Precise Plan, and applicable provisions of the Subdivision Map Act, the
<br />Redwood City Municipal Code and Zoning Ordinance.

<br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
<br />CITY OF REDWOOD CITY AS FOLLOWS:
<br />
<br />Section 1. The City Council, having independently heard, considered and
<br />weighed all the evidence in the record, f including evidence presented by City staff, the
<br />Applicant, the Appellants and members of the public, and being fully informed of the
<br />Project, the Planning Commission’s decision, and the appeal, finds that the Appellants
<br />have not shown, based on evidence in the record, that the Planning Commission’s
<br />decision was made in error, that there was an abuse of discretion by the Planning
<br />Commission, that the Planning Commission’s decision was otherwise improper, or that
<br />the City’s notices, agendas, and appeal procedures were unlawful in any manner, and,
<br />in the exercise of its independent judgment, hereby denies the appeals and approves
<br />the Downtown Planned Community Permit including five guideline deviations, Tentative
<br />Map, Condominium Permit, and Planned Development Permit based on the following
