29 � <br /> RESOLUTION N0. 7303 AWARDING CONTRACT FOR THE <br /> INSTALLATION OF A SUSPENDED CEILING SYSTEM MULTI- <br /> PURPOSE ROOM AT THE FAIR OAKS COMMUNITY CENTER; <br /> AUTHORIZING EXECUTION OF CONTRACT FOR SAID WORK; <br /> �„ AND DIRECTING RETURN OF SECURITY DEPOSIT <br /> The resolution was adopted unanimously by roll call <br /> "'`"' vote. <br /> Report re waterfowl hunting <br /> Cit Manager Fales referred to his report of November l, <br /> 197� regarding the request of the Waterfowlers Asso- <br /> ciation to amend the City Code to allow the use of <br /> shotguns in certain areas and transmitting comments <br /> from U. S. Department of the Interior-Fish and Wildlife <br /> Service, the State Department of Fish and Game, and the <br /> Police Chief. Mr. Fales advised that comments have been <br /> solicited from others who have not replied . <br /> John Fritz, Chairman, Waterfowlers Associa,tion, advised <br /> t at �ierrequested hunting would take place in the tide- <br /> land area, so no hunter should be on dry land beyond the <br /> high water mark. <br /> Discussion followed and Mr. Fritz and City Attorney <br /> Schricker replied to questions and commented on various <br /> aspects of the request of the Waterfowlers. Observation <br /> ""�" was made that even if the Council wished to amend the <br /> Code as requested by the Waterfowlers without further <br /> �• study, the ordinance could not be effective for 4�4 days <br /> (December 18) , and the duck season ends about January 19. <br /> Pete Uccelli, Pete ' s Harbor, urged favorable consideration <br /> o� e request of the Waterfowlers, noting that as good <br /> sportsmen who observe regulations, �hey should not be <br /> penalized for the irresponsible behavior of some who <br /> discharge guns in the baylands. <br /> Bill Chambers, San Mateo, property owner in Redwood City <br /> an mem er o the Waterfowlers Association, read the <br /> letter to Assistant City Manager Smith from the Deputy <br /> Director of the State Department of Fish and Game recom- <br /> mending tha.t the City allow the use of shotguns as re- <br /> quested by his organization. Mr. Chambers advised that <br /> only a very few hunters would be involved, mostly on <br /> weekends during the 90-day season. Mr. Chambers also <br /> called attention to court decision Marks v. Whitney <br /> E C. 251; Cal.
