49 _- - - -- Expansion of Police Communication System ( see above also ) City Attorney Schricker read the title of the resolution awarding bid with regard to expansion of the police communication system . MOTION : Councilman Henderson introduced the following resolution , title having been read , and moved , seconded by Councilman Leipzig , its adoption : Resolution No . 7044 Approving and Authorizing Agreement with Motorola , Inc . for the Purchase of Certain Electronic Equipment . The resolution was adopted unanimously by roll call vote . Oral Communications Bob Rossman , 11 Springdale Way , Cordilleras Valley Association , spoke in objection to the issuance of a use permit without a public hearing to an alcoholic beverage licensee , namely "The Faucet . " He stated that because no hearing was advertised , only two people from the neighborhood were present at the time the permit was granted by the Planning Commission in accordance with staff recommendation . Mr . Rossman stated that certain misrepresentations were made by the applicant and that the establishment has had a cease and desist order from the City posted on it for several days . Mr . Rossman advised that residents of the area were present at the Alcoholic Beverage Control hearing at the time the license was granted . He re - quested that the matter be returned to the Planning Commission and that a public hearing be held on the granting of the use permit . City Attorney Schricker advised that there is no provision for appeal after the deadline in the matter of the issuance of use permits . He advised also that there are revocation proceedings in the event a permit holder does not operate within the conditions specified when a permit is granted . City Manager Fales advised that if a notice was posted in this instance , as re - ported by Mr . Rossman , then the enforcement of the conditions of the permit is under way . Director of Planning Schroeter explained the series of steps involved if there are or appear to be violations of use permit conditions . In response to Mr . Rossman ' s question about an EIR being filed in connection with the subject property , Mr . Schroeter said he would be happy to check into the matter of whether such a report was required . Executive Session MOTION : Councilman Norris moved , seconded by Councilman Leipzig , that the Council adjourn to an executive session . The motion carried unanimously by voice vote . Mayor Keckley announced that the Council would reconvene only for the purpose of adjourning . The Council adjourned to executive session at 9 : 25 p . m .
