118 <br /> The lawsuit initially affected property northerly of this City <br /> ( in vicinity of Coyote Point ) ; however , defendant , Westbay <br /> Community Associates , cross - complained , bringing to the lawsuit <br /> question of title to considerably more lands than initially <br /> involved . Effect of the cross -complaint considerably increases <br /> complexity of the suit . In view of ramifications to City in <br /> the event the private developer should prevail , Committee <br /> recommended support of AB 1479 in order that the State may <br /> effectively pursue the legal battle in representing the public <br /> the public interest . 4 . Labor Relations Legislation . Under <br /> HR 51 , the Assembly ' s house resolution regarding public employer - <br /> employee relations , and Assembly Advisory Council was formed <br /> and is presently holding hearings , to provide recommendations <br /> regarding comprehensive legislation regulating public employer- <br /> employee relations . A number of bills which would have amended <br /> various provisions relating to public employer-employee relations <br /> had been dropped or " taken under submission " in view of the <br /> formation of the Council . Among such bills is AB 1850 , sponsored <br /> by League of California Cities and the County Supervisors <br /> Association of California . Notwithstanding that most bills <br /> had been dropped on the understanding a more comprehensive <br /> review and recommendations would be forthcoming , AB 452 and <br /> SB 1440 were still pending and could be enacted at any time . <br /> AB 452 would make the 2% at age 50 retirement formula for policemen <br /> and firemen ( CHP Plan) , effective July 1 , 1973 , without sufficient <br /> funding for local agencies to carry out the plan . Committee <br /> strongly recommended opposition to AB 452 . <br /> Supplement to Legislative Committee Report 72 -3 , dated July 24th , <br /> advised of a substantial revision to SB 1440 , originally opposed <br /> by the Committee . As amended , SB 1440 includes the following <br /> provisions : Creation of a five -member California Public Employee <br /> Relations Board and outlines powers and duties of the Board ; <br /> defines the scope of representation and enumerates management <br /> rights , includes procedural and jurisdictional requirements for <br /> fact finding and authorizes mediation ; and defines prohibited <br /> practices for employers and employees , including specific <br /> prohibition of strikes , etc . As amended , the bill closely <br /> follows the provisions of AB 1850 , the labor relations bill <br /> sponsored by League of California Cities and County Supervisors <br /> Association of California . Committee had heretofore recommended <br /> approval of AB 1850 . Under the circumstances , Committee now <br /> 7/24/72 <br /> Reg . Mtg . <br />
