495 <br /> City Attorney questioned Mr . Royer if it was his position now that he was <br /> changing the comments which were made on his application , or the statement <br /> of justification , with regard to the special circumstances applicable to the <br /> property, keeping in mind the requirement of the Ordinance , which is that <br /> because of special circumstances applicable to the subject property including <br /> size , shape , topography , location or surroundings , the strict application of the <br /> ordinance will deprive subject property of privileges enjoyed by other <br /> properties in the vicinity and under identical zone classification . He noted <br /> that Mr . Royer had indicated a negative answer to those questions on the <br /> statement of justification . <br /> Mr . Royer replied that he did feel there are special circumstances surrounding <br /> the property that fit the requirements of the Ordinance . City Attorney asked <br /> that he inform Council in what particulars the circumstances exist . Mr . Royer <br /> stated that on the rear yard setback there is a specific reason why the size of <br /> the property affects the property development and the request for the variance <br /> and that is the fact that the frontages on both streets are so close to being <br /> the same , and the fact that the major portion of it fronts on Lincoln , <br /> request for variance was made on the basis of size of the property . Attorney <br /> asked if Lincoln were the frontage would there still be need for the parking <br /> variance , and Mr . Royer replied in the affirmative . He also stated that the use <br /> of the property and the type of the project is a specific reason for the request . <br /> Council requested clarification of some questions by the Housing Authority <br /> representative , specifically regarding age and health eligibility , the approach <br /> to subsidy , how it is administered , and how it is applied for . <br /> Morgan Griffiths , Housing Coordinator with the County <br /> of San Mateo Housing Authority , informed Council that <br /> the age mentioned , 62 , is correct . In the matter of <br /> health , this is determined on an individual basis . It <br /> is for the apartment manager to determine if they are no <br /> longer able to take care of themselves or have no one <br /> living with them to take care of them and therefore must <br /> be moved to other facilities that would be available in <br /> the County . <br /> Application is made to the San Mateo Housing Authority . <br /> Nearly every applicant is a long-time resident of San <br /> Mateo County . There is a long waiting listwith few units <br /> available , and a current study being made by the County <br /> indicates approximately 11 , 000 individuals or families <br /> would be eligible under the low and moderate income <br /> bracket . Once they have applied , they are interviewed <br /> and their income is determined . It is required that <br /> the tenant pay no more than 25% of his income for rent . <br /> There is a double subsidy involved with the Federal <br /> Government , in that the Housing Authority may set an <br /> individual ' s rent at $ 50 per month but he may be charged <br /> $20 a month . The Federal Government would first send a <br /> subsidy of $30 , and then later send the difference <br /> between $50 and what they pay the landlord , what the <br /> overhead is and what the tenant pays the Housing <br /> Authority . Rents do fluctuate . The average contract <br /> rate is $52 , but the tenants are actually charged less <br /> than that . <br />
