237
Councilman Arnett directed to Planning Director a question concerning the
Commission's report which referred to the Citizens Advisory Committee's
goals recommending high density development to be located more closely to
the downtown core area. Planning Director responded that it should be
understood the Citizens Advisory Committee had not considered the proposal
under consideration, and therefore, any inference they would favor it
would be misleading. As he understood the goals, the Committee was against
such development in outlying areas, and favored promoting high density
development near downtown, where studies had shown that families residing
near downtown account for more than 50% of that area's purchasing activity,
while residents on Rolison Road do less than 30%. While this industrially
zoned land does remain vacant, he foresaw problems if, at some future point
when it becomes needed, it is no longer available. The Planning Commission
was not opposed to the development, but was opposed to this location for it.
They also recognized the economics, in that Downtown property is more
expensive.
Planning Director responded to additional questions from Council, advising
that relative to depth of the property, there are many industrial developments
on shallower parcels. He indicated locations of R-5 zoning; i.e., Brewster
at Whipple, some property adjacent to Sequoia High School, and two smaller
areas southeast of downtown and Marshall Street apartment development.
Councilman Henderson moved to close the public hearing, seconded by Councilman
Weymouth and carried.
Councilman Petersen moved to REVERSE the action of the Planning Commission and
grant rezoning as requested, seconded by Councilman Weymouth, Councilman
Petersen spoke in justification of his motion. Councilman Henderson stated
she was opposed to the motion, and quoted portion of Planning Commission report
which expressed reasons for their objection to the rezoning, Councilman
Keckley spoke in favor of the motion and felt changing the zoning to R-5,
if the development is well planned, would provide an attractive buffer for
the adjacent existing homes, Mayor Bury agreed, indicating zoning to R-5
would be logical and to the benefit of the residential area on one side,
as well as to the industrial on the other, There was brief discussion
relative to proposed density ordinance recently under consideration and
which failed to pass, as it would have related to the matter under discussion
and it was indicated that without a Use Permit the development would have been
limited to 110 dwelling units, although with a Use Permit, the proposal would
come within the restrictions. Councilman Arnett indicated that since he had
supported that ordinance restricting density, it would be inconsistent for
him to approve this application,
Motion carried on roll call vote, Councilmen Keckley, Petersen, Weymouth and
Mayor Bury voting yes; and Councilmen Arnett, Henderson, and Rhodes voting no,
Councilman Keckley moved to introduce Ordinance adding Section 60,4.1 to Ordinance
No. 1130, rezoning property in the vicinity of Second Avenue and Broadway,
seconded by Councilman Petersen and carried on roll call vote, Councilmen
Keckley, Petersen, Weymouth and Mayor Bury voting yes; Councilmen Arnett,
Henderson and Rhodes voting no.
REPORT OF BID OPENING, Fittings, Brass, AWWA.
