<br /> Councilmembers advised again that the City did not fund nor was it <br /> ----.. involved in any festival, including the Fourth of July. The City issued <br /> permits for street closures, but all aspects of the festival were the <br /> responsibility of its sponsors and participants. <br /> ----------------------------------------------------------------------------- <br /> 5. GENERAL <br /> A. INTRODUCTION <br /> 1) Mayor Buchan welcomed the Port Commissioners and staff to the study <br /> session and said how glad the Council was to meet with the Port <br /> Commissioners. <br /> 2) Board of Port Commissioners Chairman Smith welcomed the Council and <br /> presented a brief and interesting history of the Port. Chairman <br /> Smith described the Port's increased tonnage, expansion plans, new <br /> marina and berths, leases, recycling, rail transfers, international <br /> imports, restaurants, offices, and short term leases. Chairman <br /> Smith emphasized the Port's goals of profitability and a secure <br /> asset for the citizens of Redwood City. <br /> -------------------------------------------------------------------------- <br /> B. SUMMARY OF LEGAL RELATIONS BETWEEN CITY AND PORT <br /> 1) City/Port Attorney David E. Schricker presented a brief synopsis of <br /> the legal relations between the City and the Port as established in <br /> the Redwood City Charter, including: "Section 47a. BOARD OF PORT <br /> COMMISSIONERS: The exclusive control and management of the Port <br /> Department is hereby vested in the Board of Port Commissioners, which <br /> shall be composed of five (5) members who shall be appointed by the <br /> Counc i 1 ." <br /> In response to Council questions, City/Port Attorney Schricker advised <br /> the Council that the Port acquires property in the name of the City <br /> and can sue and be sued, in the name of the City. Also, the Charter <br /> requires an annual meeting between the City and the Port. The Charter <br /> also states: "Section 48d. REPAYMENT OF FUNDS: ..the Board shall <br /> annually pay over to the General Funds of the city profits from the <br /> operation of the port and any surplus funds which in its judgment may <br /> not be needed for port purposes." City/Port Attorney Schricker <br /> advised that the Charter prohibits the Council from involving itself <br /> in the operation of the Port, but the Council did have the power to <br /> appoint the Commissioners, and to remove them by a 5/1 vote. <br /> City/Port Attorney Schricker advised that the Charter mandates a <br /> transfer of Port profits and surpluses to the City's General Fund, but <br /> does not preclude communications between the City and the Port on <br /> policy matters: They share a common policy goal; and, success for the <br /> Port is success for the City. <br /> -------------------------------------------------------------------------- <br /> Study Session Minutes <br /> September 20, 1993 MINUTE BOOK NO. 51 <br /> Page 2 Page No. 531 <br /> ,-- .._--- -----------,- ---------" <br /> Ii <br />
