Contract Price, related to an executed Change Order, or otherwise categorized by <br /> Contractor as extra work. Contractor's failure to comply with this provision as to any <br /> claimed cost operates as a waiver of any rights to recover the claimed cost. <br /> B. Contractor must continue to maintain its Project records in an organized <br /> manner for a period of four years after City's acceptance of the Project or following <br /> termination, whichever occurs first. Subject to prior notice to Contractor, City is entitled <br /> to inspect or audit any of Contractor's Project records relating to the Project or to <br /> investigate Contractor's plant or equipment during Contractor's normal business hours. <br /> 1 . 10 Representations. Contractor has visited the Site and has examined <br /> thoroughly and understood the nature and extent of the Work, Site, locality, actual <br /> conditions, as built conditions, and all local conditions and federal , state and local laws <br /> and regulations that in any manner may affect cost, progress, performance or furnishing <br /> of Work or which relate to any aspect of the design and the means, methods, <br /> techniques , sequences or procedures of construction to be employed by Contractor and <br /> safety precautions and programs incident thereto. <br /> 1 . 11 Noninterference. Contractor must take reasonable measures to avoid <br /> interfering with City's use of its property at or adjacent to the Project site, including use <br /> of roadways, entrances, parking areas, walkways, and structures. <br /> 1 . 12 Clean up . Contractor must regularly remove debris and waste materials <br /> and maintain the Worksite in clean and neat condition . <br /> (A) General . Prior to discontinuing work in an area, Contractor must clean the <br /> area and remove all rubbish along with its construction equipment, tools, machinery, <br /> waste and surplus materials. Contractor must, at all times, minimize and confine dust <br /> and debris resulting from construction activities. <br /> (B) Completion . At the completion of the Work, Contractor must remove from <br /> the Worksite all of its equipment, tools, surplus materials, waste materials and debris. <br /> Before demobilizing from the Worksite, Contractor must ensure that all surfaces are <br /> cleaned , sealed , waxed, or finished as applicable, and that all marks, stains, paint <br /> splatters, and the like have been properly removed from the completed Work and the <br /> surrounding areas. <br /> (C) Non-Compliance. If Contractor fails to commence compliance with its <br /> cleanup obligations within two business days following written notification from City or <br /> its representative, City may undertake appropriate cleanup measures without further <br /> notice and the cost will be deducted from any amounts due or to become due the <br /> Contractor. <br /> 2. Standard of Performance. While performing the Services, Contractor will exercise <br /> the reasonable professional care and skill customarily exercised by reputable members <br /> of Contractor's profession practicing in the urban Northern California Area, and will use <br /> REV: 07-06-16 FF <br /> Page 3 of 11 <br /> ATTY/AGR.2016. 177/EG Concrete Construction <br />
