. ` <br /> . <br /> 1 <br /> 1 <br /> 1 <br /> (c) If the amount of Available Funds exceeds the cost of <br /> Essential Restoration and Minimum Restoration, then in addition to Essential Restoration and <br /> Minimum Restoration, each Owner shall undertake and complete in accordance with this REA, <br /> to the extent of such excess Available Funds, such additional Restoration of Improvements in or <br /> on its Parcel as such Owner may elect. <br /> Notwithstanding the foregoing, an Owner shall not be required to complete any work <br /> other than Essential Restoration in the absence of adequate assurance from the other Owner that <br /> it has sufficient Available Funds to fulfill its Restoration obligations hereunder. <br /> (4) Within a reasonable period of time, the Restoration required <br /> herewith shall be commenced and completed. <br /> 5.3 Clearing Debris from Raised Improvements. Except to the extent <br /> provided otherwise in Sections 5.2 and 5.4, If the Party upon whose Parcel the damage or <br /> destruction has occurred is not obligated to restore an Improvement that has been damaged or <br /> destroyed, and if Such Party elects not to do so, then it shall raze such Improvements (or such <br /> part thereof as has been damaged or destroyed) and clear the area of all debris and Landscape the <br /> area. If an Owner elects not to restore as permitted hereunder, the parties shall meet and confer <br /> in good faith and work cooperatively towards the goal of preserving their respective values in the <br /> Property." <br /> 5 <br />
