DEPOSIT FOR PLAN CHECK AND INSPECTION . Owners shall deposit with City a sum to be determined in accordance with the formula and schedule described in Resolution No . 11333 , adopted July 9 , 1990 by the Council of the City of Redwood City relating to the establishment of a fee schedule for permit processing and related services provided by the Department of Community Development , or any subsequent revision , replacement , or superseding fee schedule ( the " Deposit " ) , less all amounts previously paid City by Owners for such tip G7 C3 services , to compensate City for all engineering , inspection , plan check , laboratory and field testing , construction , and other ;N) services furnished by City in connection with the Future ; D Improvements for the said subdivision . Owners understand that the Deposit is an estimate and further agrees to pay to City the actual cost of providing such services , in accordance with the formula and schedule described in said Resolution No . 11333 . Owners agree to pay such additional sum or sums for the services provided by City , if any , within ten ( 10 ) days after transmittal of a statement by City listing the additional sum to be paid and agrees that the amount payable shall be increased by ten percent ( 10 % ) in the event payment is not made within such ten ( 10 ) day period . Any part of the Deposit or such additional sum or sums not utilized by City shall be returned to Owners . 16 . IMMUNITY FROM ACTS OF GOD . Owners shall not be in default of any provision of this agreement or subject to any penalty hereunder where timely performance or timely compliance is prevented 11
