The Future Improvements include , but are not <br /> limited to : Concrete curb , gutter , sidewalks , valley gutter , <br /> driveway , street lighting , storm drain system , street trees , street <br /> monuments , underground utilities ( gas , electric , telephone and cable <br /> T . V . facilities ) and street widening to public street standards <br /> ( including grading , site preparation , headerboards , and construction <br /> of bedding and pavement sections ) in accordance with plans and <br /> specifications therefor approved by City for the entire frontage of <br /> the Property on West Oakwood Boulevard . (fl <br /> Cn <br /> ( c ) Acceptance . Upon completion of construction of the Future C <br /> Improvements in accordance with plans and specifications approved by --f <br /> City , City shall accept said construction . Upon such acceptance , NY <br /> Q' <br /> Owners shall convey title to said improvements to City . <br /> ( d) Failure to Construct . In the event Owners fail to <br /> construct said Future Improvements , or fail to construct said <br /> improvements in accordance with the plans and specifications <br /> therefor approved by City , City hereby reserves the right to <br /> construct said improvements at Owners ' cost and expense . In the <br /> event City elects to proceed with the construction of said Future <br /> Improvements , City shall give Owners not less than thirty ( 30 ) days ' <br /> prior written notice of said election , and within said thirty ( 30 ) <br /> day period Owners shall deliver or otherwise make available to City <br /> all materials , supplies , and equipment , if any , which Owners may <br /> have ordered or own or possesses for such construction . Upon taking <br /> possession thereof , City may use such materials , supplies and <br /> equipment to construct , or complete construction of , said Future <br /> Improvements . <br /> 3 <br />
