ATTOREY'S FEES. <br /> <br /> In the event of any mediation, arbitration or litigation to enforce any of the <br />provisions of this Agreement, each party shall bear its own attorney's fees and costs. <br /> <br /> 9. ETIRE AGREEMET. <br /> <br /> This Agreement is the final expression of the complete agreement of the parties <br />with respect to the matters specified herein and supersedes all prior oral or written <br />understandings. Except as prescribed herein, this Agreement cannot be modified except <br />by written mutual agreement signed by the parties. <br /> <br /> 10. ASSIGMET. <br /> <br /> This Agreement is not assignable by either City or Employee. <br /> <br /> 11. SEVERABILITY. <br /> <br /> In the event that any provision of this Agreement is finally held or determined to <br />be illegal or void by a court having jurisdiction over the parties, the remainder of the <br />Agreement shall remain in full force and effect unless the parts found to be void are <br />wholly inseparable from the remaining portion of the Agreement. <br /> <br /> 12. MISCELLAEOUS. <br /> <br />Any rule of construction to the effect that ambiguities are to be resolved against <br />the drafting party shall not apply in the interpretation of this Agreement or any <br />amendment or exhibits hereto. <br /> <br />The signatures of the parties below indicate that each has read and understood the <br />Agreement and will abide by the terms stated herein. <br /> <br />This Agreement has been executed by the parties on the dates noted below. <br /> <br /> <br />6.3.A. - Page 9
