186 discussion concerning the possibility of regulating such construction , but the conclu- sion seemed to be that in the absence of a restriction in the conveyance of the property , nothing could be done . However , on motion of Councilman McCarthy , seconded by Councilman Fletcher , the Building Inspector was authorized to refuse to grant to E . W. Magruder , or anyone else , building permits for houses of such value . Councilman Eva again brought up for discussion the question of loose dogs running about the City and all the Council members concurred in the belief that something ought to be done. Finally, it was decided , on motion of Councilman McCarthy , seconded by Councilman Jones , to ask the Attorney to prepare an ordinance under the terms of which dogs , off the premises of their owners and not in closed cars , must be on leash. Motion carried , with Councilman Fletcher , Christensen and McNulty voting "No" . Following a discussion by Councilman Eva concerning the desirability of changing Section 56 of the Charter which fixes the maximum tax rate for purely governmental functions at $1 . 00 so that the maximum rate should not exceed $1 . 50 , he so moved, seconded by Councilman Christensen , and the motion was carried. The City Attorney was therefore instructed to make the necessary preparation to have this put on the ballot at the coming election. Councilman Eva also discussed the desirability of changing or eliminating that portion of Section 26 of the Charter reading as follows: "No one shall be eligible for appoint- ment thereto who has not served as City Manager or as an assistant or a deputy thereof for at least/one year" . On motion of Councilman Eva, seconded by Councilman McNulty , this was also unanimously carried., with instructions to have it placed on the ballot . Councilman McCarthy explained that while he voted in favor of the motion , he believed the restrictions in regard to the qualifications of the City Manager should stand as they are . Councilman Eva called attention to the dangerous condition of the small bridge leading from the end of Hamilton Street to Pennsylvania Avenue , and the City Manager ex- plained that he would take care of it . Councilman Eva also asked about the Council ' s attitude toward Hawes Park Softbaseball Or- ganization for the summer. He was given authority to represent the Council at a preliminary meeting for organization. On motion of Councilman Eva, seconded by Councilman McNulty , the City Clerk was asked to convey to Judge McAuliffe the appreciation of the Council for the work he has done toward reducing traffic accidents.
