ATTY/AGR/2016.249/STATE OF CALIFORNIA DEPARTMENT OF PARKS & RECREATION DIVISION OR BOATING & WATERWAYS <br />REV: 09-01-16 RL <br />Page 10 of 33 <br />insured’s under Grantee’s insurance or supply evidence of subcontractor’s <br />insurance to the State when requested equal to policies, coverages, and <br />limits required of Grantee. <br />2. Insurance Requirements <br />a. Commercial General Liability <br /> <br />The Grantee shall maintain general liability on an occurrence form with <br />limits of not less than $1,000,000 per occurrence for bodily injury and <br />property damage liability combined with a $2,000,000 annual policy <br />aggregate. The policy shall include coverage for liabilities arising out of <br />premises, operations, independent subcontractors, products, completed <br />operations, personal and advertising injury, and liability assumed under an <br />insured contract. This insurance shall apply separately to each insured <br />against whom claim is made or suit is brought subject to the Grantee’s limit <br />of liability. The policy must include: <br />"The State of California, its officers, agents, employees and servants as <br />additional insureds, but only with respect to work performed under the <br />contract." <br />This endorsement must be supplied under form acceptable to the Office of <br />Risk and Insurance Management. <br />In the case of Grantee’s utilization of subcontractors to complete the <br />contracted scope of work, Grantee shall include all subcontractors as <br />insured’s under Grantee’s insurance or supply evidence of insurance to the <br />State equal to policies, coverages and limits required of Grantee. <br />b. Automobile Liability <br /> <br />The Grantee shall maintain motor vehicle liability with limits not less than <br />$1,000,000 combined single limit per accident. Such insurance shall cover <br />liability arising out of a motor vehicle including owned, hired and non- <br />owned motor vehicles. <br />c. Watercraft Liability <br /> <br />The Grantee shall maintain watercraft liability insurance with limits not less <br />than $1,000,000 combined single limit per accident. Such insurance shall <br />cover liability arising out of the maintenance and use of any watercraft <br />(owned, hired or non-owned). The policy must include: <br />"The State of California, its officers, agents, employees and servants as <br />additional insureds, but only with respect to work performed that is <br />connected with or related to the activities contemplated in this Agreement." <br />This endorsement must be supplied under form acceptable to the Office of <br />Risk and Insurance Management. <br />d. Workers Compensation and Employers Liability <br /> <br />The Grantee shall maintain statutory worker’s compensation and <br />employer’s liability coverage for all its employees who will be engaged in <br />the performance of the Agreement. Employer’s liability limits of $1,000,000 <br />are required. The insurer waives any right of recovery the insurer may have <br />6.1.M. - Page 12
