<br />ANALYSIS <br />Linden Park is a valued asset to this particular neighborhood, and PRCS staff have <br />provided great effort to move this project forward through a very complex, tedious, and <br />often frustrating process. Staff and SSA is currently working on the 95% contract <br />document submittal and City staff has been working concurrently on the new license <br />agreement to allow the project to continue through the construction phase. Construction <br />is allowed only with the agreement and the corresponding insurance in place. <br />The SFPUC Revocable License Agreement is for an eight year term, and requires three <br />million dollar commercial general liability insurance per occurrence, builder’s risk, <br />business automobile liability and worker’s compensation insurance and a broad <br />indemnity clause whereby the City agrees to indemnify, protect, defend and hold <br />harmless SFPUC and City and County of San Francisco for all losses as described in <br />the agreement. The agreement, requires Council approval before its submittal to the <br />San Francisco Public Utilities Commission for approval. <br />If the SFPUC Revocable License Agreement is accepted by the City and Commission in <br />September or October of this year, the public bid could follow in late 2016, and <br />construction could begin early 2017. We anticipate construction would be completed in <br />90 days and the park open in Spring 2017. <br />ALTERNATIVES <br />Council may choose not to approve the Revocable License Agreement with SFPUC; or <br />could request that staff revisit the terms of the License Agreement with SFPUC. <br /> <br />FISCAL IMPACT <br />The City Council has approved Park Impact Fee appropriation towards the Linden Park <br />reconstruction project in the amount of $491,594. The amount includes all design, <br />construction and management. The License Agreement fee to SFPUC is $750. <br /> <br />ENVIRONMENTAL REVIEW <br />The Linden Park Renovation Project consists of the reconstruction of the previous park <br />that was demolished during an SFPUC pipeline upgrade as well as an expansion of the <br />park area. As proposed, the project is categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA) Guidelines per Section 15303 “New <br />Construction or Conversion of Small Structures” for the construction of the children’s <br />play features (including caterpillar-shaped benches, stepping pavers, painted wood <br />stack log walls, willow structures, balancing logs and egg seats), benches, fencing, and <br />signage; and Section 15304 “Minor Alterations to Land” for associated cut and fill of <br />soils, trenching and backfill, grading, landscaping, and placement of a 10’ wide <br />pathway, limited concrete paving and decomposed granite pathways. <br /> <br />There will be no significant cumulative impact or significant effect on the environment <br />when considering the totality of the project as the proposed park will be primarily <br />6.1.C. - Page 4
