<br />Page 7 of 14 <br />ATTY/RESO.0082/CC RESO DTPP AMENDMENT TO PRESERVE AND EXPAND ACTIVE GROUND FLOOR USES <br />REV: 09-08-16 RL <br />The following standards and guidelines shall apply to all uses. <br /> <br />1. Standards <br />a. All permitted uses for a single Use Zone are allowed either alone or in <br />combination with any other permitted uses within a parcel. <br />b. The following uses are prohibited in all Use Zones and Use Groups: <br />• Check cashing stores <br />• Drive-up businesses <br />• Hospitals <br />• Industrial uses <br />• Jails, penitentiaries, and other incarceration facilities <br />• Service yards, or other such outdoor facilities used for the storage of fleet <br />vehicles, equipment, and materials <br />• All other uses not expressly listed in this section as permitted uses and which <br />are not deemed by the Planning Manager/Designee to meet the intent of the <br />plan. <br />c.b. All uses shall provide necessary space on-site, within an enclosure or a trash <br />room, for all trash storage and recycling storage needs related to the use. Trash <br />storage facilities or containers shall not be allowed on public streets, plazas, or <br />parking lots. <br />d. In order to preserve historic resources by enhancing their economic viability for <br />adaptive reuse, historic buildings shall be exempted from certain ground floor use <br />restrictions. Therefore, historic resources, as designated on the Use Regulations <br />Map, shall always be treated as “Typical” in determining permitted uses. <br />[Subsections e, f, g, h, and i are hereby re-lettered as subsections c, d, e, f, and g, <br />respectively.] <br />j. Adult entertainment establishments shall conform to the requirements of Article 27 <br />of the Zoning Ordinance. <br />[Subsections k and l are hereby re-lettered as subsections h and i, respectively.] <br />m. Buildings which were constructed before the adoption of this plan on January 24, <br />2011, and which were designed and used for retail uses prior to that date may <br />continue to be used as retail spaces, even if the site presently does not permit <br />retail uses per the Use Regulations Chart. Pre-existing buildings or spaces which <br />were not used for retail purposes prior to the adoption of this plan cannot be <br />converted to retail use if they are prohibited by this plan. New construction must <br />comply with all use regulations which apply to the site. <br />m. Wireless communications facilities are permitted through a Use Permit and shall <br />comply with Article 38 of the Zoning Code. <br />[Section 2. Guidelines remains unchanged.] <br />7.A. - Page 17
