4 <br />recommend an incentive program for early compliance, and develop a reasonable time frame for <br />individuals to move. <br /> <br />Following adoption of a Docktown Plan, the agreement authorizes OPC to begin implementing <br />the approved Plan by providing consultant services such as vessel acquisition for certain vessels, <br />calculation of relocation payments, and coordination of relocation assistance. The detailed Scope <br />of Services for the preparation and implementation of the Plan are set forth in the agreement. <br />After relocation assistance has been provided, the Docktown Marina will be closed and the dock <br />facilities will be removed. <br /> <br />Public Review – The City has invited community members to provide comments on or <br />suggestions for the Docktown Plan at any time at docktown@redwoodcity.org. The draft <br />Docktown Plan is expected to be released in mid-November, and feedback will be sought both <br />through individual meetings and a community meeting. Following the community meeting, the <br />City Council will consider the feedback received on the draft Plan and will discuss it during an <br />open, publicly noticed City Council meeting in December. In order to comply with the Settlement <br />Agreement, a Docktown Plan that complies with the granting statues and the Public Trust <br />Doctrine must be adopted by the end of 2016 and implementation of the adopted Plan must begin <br />in 2017. <br /> <br /> <br />FISCAL IMPACT <br /> <br />The consulting contract is a professional services agreement and is not subject to bidding <br />requirements for selecting the lowest cost estimate. The OPC proposal turned out to be the <br />lowest cost estimate of the four submitted proposals, however, the selection committee more <br />heavily weighted the experience of the firm and their approach to the assignment. The amended <br />agreement will have a not to exceed cost of $311,668 as set forth in Attachment B. <br />The January 2016 litigation Settlement Agreement required the City to set aside a $3 million <br />reserve for costs associated with preparation and implementation of the Docktown Plan. The cost <br />of the OPC agreement will be funded from this reserve. <br />The estimated cost of providing relocation assistance will be determined as part of the draft <br />Docktown Plan released in mid-November. At that time, staff will provide the City Council with an <br />analysis of funding mechanisms to pay for these costs. <br /> <br />ENVIRONMENTAL REVIEW <br /> <br />Approval of the agreement is an activity that is not considered a project under CEQA guidelines <br />Section 15378 (b) (5) as it will not result in direct or indirect physical changes in the environment. <br /> <br /> <br />8.A. - Page 4
