All Executive Management personnel will participate in the City's payroll direct deposit <br />program. Employees shall be paid biweekly in accordance with City-wide payroll <br />procedures. <br />TERMINATION AND SEVERANCE PAY <br />The Chiefs of Police and Fire, as well as all Directors and the Assistant City Manager shall <br />be offered employment agreements which shall include an offer of severance pay. Said <br />employment agreements will be required for newly hired or promoted employees in these <br />classifications and optional for current employees in these classifications. The severance <br />pay offered to the Chiefs of Police and Fire, Directors, and Assistant City Managers is a <br />one-time lump sum equal to six (6) full months of monthly base salary plus the equivalent <br />of six (6) months of 401(a) contributions and City -sponsored health, dental and vision <br />benefits premiums. Said employment agreements shall be approved as to form by the <br />City Attorney and may be amended from time to time as necessary. <br />Nothing in this Summary of Benefits shall be interpreted to be in conflict with, or to <br />eliminate or modify in any way, the at -will employment status of any employee. The at - <br />will employment status of an employee may be modified only in a writing expressly so <br />stating signed by the City Manager and approved by the City Council in open session at <br />a public meeting. <br />Pursuant to California Government Code sections 3304, subdivision (c), and 3254, <br />subdivision (c), Police and Fire Chiefs shall not be removed without written notice and <br />the reason(s) therefor and an opportunity for an administrative appeal. Such <br />administrative appeal must be filed in writing by the Police Chief with the City Manager <br />or their designee within ten (10) work days from the date of termination; and unless so <br />filed, the right of appeal is lost. "'Work day" is defined as any day when City Hall is open <br />for public business. The Fire Chief appeal process will follow the appeal process in the <br />Chief Officers' Association (COA) MOU. <br />III. LEAVE <br />a. Vacation — Vacation accruals will be set by the City Manager based on years of <br />service with City and total public sector years or years in the industry. <br />Executive Management will accrue vacation based on years of service based on <br />the following schedule: <br />■ Date of Hire through the fourth year of service — 3.077 hours per pay period, <br />yields 80 hours of vacation per year). <br />+ Fifth through the ninth year of service — 4.615 hours per pay period, yields <br />120 hours of vacation per year. <br />ATTY/AGR/2023/AMEND.
