SECTION 00520 AGREEMENT for the City of Redwood City HERON SCUI.PTURE OUTDOOR ART INSTALLATIOId THIS AGREEMENT, made this�day , 20 , by and between Golden Bay Construction, Inc. whose place of busin is at 3826 De t Road, Haywarcl, CA s4545 hereinafter called "CONTRACTOR", and the City of Redwood City, a Charter City and muniapal corporation of the State of Califomia, hereinafter referred to as`CfTY". In consideration of the mutual cavenar�ts hereinafter set forth, Contractor and City agree as follows: i. wowc A. Contractor shal[ complete all Work specified in the Contract clocuments, in accordance with the Speafications, Drawings, and all other terms and conditions of the Contract documerrts. II. CONTRACT SUqN A. City shalf pay the Contractor as the "Contract Sum" for completion of Woi-k in accordance with the Contract documents, as the amount of Thirteen Thousand Four Hundred Eighty-Six and No/10U Dollars ($13,486.00}, computed in accordance with Cantractor's Acxepted Proposal dated, August 19, 2018, which Propo�al is incorporated herein by reference thereto as if fully set forth. B. The Contract Sum is all i�c{usive and includes all Work; all federai, state, and local taxes on materials and equipment, and labor fumished by Contractor, its subcontracta,s, subconsultants, a�itects, engineers, and vendors or otherwise arising out of Co�rtractor's performanoe of the Wor1c, including any increases in any such taxes during the term of this Agreemer�t; and any dutles, fees, and royaldes imposed with respect to any materials and equipmer�t, labor or servic�es. The taxes cover+ed hereby indude {but are not limited to) occupaational, sales, use, exase, unemploymer�t, FICA, and income taxes, custams, duties, and any and all other taxes on any item or service that is part of the Work, whethe� such taxes are namally included in the prioe of such item or service or are norrnally stated separately. Nofi+uithstanding the foregoing, each party shaU bear such state or local inveritory, real property, personal property or �xtures taxes as may be properly assessed against�by applicab�taxing authorities. III. CONTRACT TIME AND LIQUIDATED DAMAGES A. Car�tractor shall complete the Work within the following Schedule reflecting the date the Contract Time cflmmenc�s to run as set fotth in Section 0055Q {Notice to Proceed) and Sec�ion 00700(Genera! Conditions}; and 1. Contractor shall achieve Substarrtial Completion of the Waic within 30 Calendar Days from the date the Contract Time commences to run.
