The Contractor warrants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of services required under the contract resulting from this NIB. The Contractor also warrants that, to the best of its knowledge, no officer, agent or employee of the City who shall participate in any decision relating to this NIB and the resulting contract, currently has, or will have in the future, a personal or pecuniary interest in the Contractor's business. 19. Disqualification A Contractor will be disqualified from the NIB process if any of the foliowing apply to the Contractor: • Evidence of collusion, directly or indirectly, among Contractors in regard to the amount,terms or conditions of this NIB; • Any attempt to improperly influence any member of the selection committee; • Existence of any lawsuit, unresotved contractual ciaim or dispute between Contractor and the City; • Evidence of incorrect information submitted as part of the Bid; • Evidence of Contractor's inability to successfully complete the responsibilities and obligation of the Bid, and; • Contractor's default under any previous agreement with the City, which results in termination of the Agreement. 20. Non-Conforming Bid A Bid shall be prepared and submitted in accordance with the provisions of these NIB instructions and specifications. Any alteration, omission, addition, variance, or limitation of, from or to a Bid may be sufficient grounds for non-acceptance of the Bid, at the sole discretion of the City.
