<br /> in the construction and improvement of office buildings in the San Francisco Bay Area <br /> which comply with all applicable laws. To the best of landlord'~ actual knowledge there <br /> is current no investigation, cleanup, or redemption order not existing, pending, or <br /> threatened with respect to the Property. landlord agrees to indemnify Tenant against any <br /> liability imposed or costs incurred in connection with the presence, investigation, or <br /> redemption of Hazardous Materials introduced to the Property by landlord. <br /> ARTICLE 5: INSURANCE AND LIABILITY <br /> 5.1 landlord's Building Insurance. <br /> landlord shall keep the Building, including tenant improvements installed at <br /> landlor~'s expense, insured against damage and destruction by fire, vandalism, and other <br /> perils in an amount equal to ninety percent (90%) of the full replacement value of the <br /> Building (excluding costs of excavation, foundation and footings, and reasonable <br /> deductible amounts), as the value may exist from time to time, and such other amounts as <br /> landlord may deem appropriate. <br /> 5.2 Property Insurance. <br /> Each Party shall keep its personal property and trade fixtures in the <br /> Premises and Building insured with "all risk" insurance in an amount to cover one hundred <br /> percent (100%) of the replacement cost of the property and fixtures. Tenant shall also <br /> keep any tenant improvements made to the Premises at Tenant's expense insured to the <br /> same degree as Tenant's personal property. <br /> 5.3 Liability Insurance. <br /> Each Party shall maintain comprehensive (or commercial) general liability <br /> insurance, including public liability and property damage, with a minimum combined single <br /> limit of liability of Two Million Dollars ($2,000,000.00) for injuries or deaths of persons <br /> occurring in or about the Building and Premises. <br /> 5.4 Waiver of Subrogation. <br /> landlord and Tenant agree that their respective property loss risks shall be <br /> borne by responsible insurance carriers to the extent provided in this Article 5, and <br /> landlord and Tenant hereby agree to look solely to, and seek recovery only from, their <br /> respective insurance carriers in the event of a property loss, to the extent that such <br /> coverage is agreed to be provided hereunder. The Parties each hereby waive all rights <br /> and claims against each other and against their respective officers, employees, agents, <br /> and representatives for such losses and waive all rights of subrogation of their respective <br /> 27 <br /> , .. -. -- .,,~~ <br /> i T' 'r 0"' <br />
