Hearing having been duly noticed and held by this Council on August 27, <br />1990, on the appeal of John L. Grandsaert ( "Appellant ") from the decision of <br />the Zoning Administrator to deny Appellant's application for a use permit to <br />allow the construction of an accessory dwelling unit on property located at <br />3556 Highland Avenue, Redwood City, California ( "Subject Property "), the <br />Appellant, the Zoning Administrator, and all other persons interested in <br />the matter having been heard and having been given the opportunity to be <br />heard, and this Council having fully considered the matter; <br />NOW THEREFORE, this Council hereby finds, determines and concludes as <br />follows: <br />MGIQ I** <br />1. The subject property is located in the R -1 (Residential - Single Family) <br />Zoning District (S5.1 et seq., Ordinance 1130, as amending [Zon. Ord. "]) of <br />the City of Redwood City, and contains a single - family residence. <br />2. Appellant applied to the City's Zoning Administrator for a use permit <br />which would allow the conversion of the basement of the single - family <br />dwelling located on the Subject Property into an accessory dwelling on <br />April 8, 1990. <br />3. Appellant's application for a use permit was denied by the Zoning <br />Administrator on June 14, 1990. <br />4. Appellant's application for a use permit was made pursuant to Section <br />5.3 of the Zoning Ordinance to allow the construction of an "Accessory <br />Dwelling" as defined in Section 2.5.2 of the Zoning Ordinance, comprised of <br />an independent dwelling unit within the basement of the main single - family <br />dwelling structure located on the Subject Property. <br />5. Construction of the proposed additional dwelling unit would require the <br />construction and installation of a cement platform, to serve as a floor, at <br />the rear of the main dwelling at an elevation below the street -level grade <br />of that portion of the Subject Property fronting on Highland Avenue. The <br />main dwelling presently consists of two stories. The construction of the <br />accessory dwelling would add an additional story to the building. <br />6. The construction of an accessory dwelling in the basement of the main <br />dwelling on the Subject Property would therefore violate Section 5.5 of the <br />Zoning Ordinance, which applies to buildings in the City's R -1 (Residential <br />- Single- Family) District, and provides that: "No structure shall exceed <br />two and one -half stories in height... ". <br />7. Further, section 2.5.2 of the Zoning Ordinance provides that such a <br />second dwelling unit must, among other requirements, comply with the <br />following: <br />"b... the lot upon which such unit is to be added [must] be <br />occupied by a single - family dwelling only as of the effective date of <br />this Ordinance."
